We are looking for a Workers' Compensation Claims Subrogation / Litigation Manager to join our team. The purpose of this job is to oversee subrogation recovery efforts arising out of claims payments made on issued workers' compensation policies. This position exists to ensure that ICW Group is properly identifying recovery opportunities, properly pursuing those opportunities, and continually seeking ways in which to improve recovery efforts both in California and across the country.

ESSENTIAL DUTIES AND RESPONSIBILITIES

Oversees activities within the Subrogation Litigation Management team.

  • Works to improve the quality of subrogation management within the organization.

  • Develops standards and protocols for claims personnel relating to identification and referral of subrogation opportunities to Subrogation Litigation Manager.

  • Develops and presents periodic training on subrogation in all ICW Group offices, nationally.

Manages cases for subrogation claims.

  • Coordinates outside subrogation legal counsel responsible for handling all litigated subrogation claims.

  • Conducts ongoing audits and quality assurance reviews on subrogation litigation cases being handled by outside counsel.

  • Works closely with ICW Group's claims personnel and other internal and external investigative and expert resources in conducting initial and ongoing evaluations of potential and actual subrogation claims.

  • Prepares legal and factual analyses regarding the viability and merits of potential subrogation recoveries.

  • Submits cases exceeding own authority with comments to the Vice President, Claims.

Establishes practices for factual and legal development, monitoring, settlement, and claim resolutions functions.

  • Develops standards and procedures for handling of subrogation claims internally, and the referral of litigated subrogation claims to outside legal counsel.

  • Develops and prepares periodic reports to management advising on subrogation recovery efforts, including analysis of current results against historical results, and identification of subrogation initiatives designed to drive improvement in recovery efforts.

  • Manages all areas relating to subrogation aspect of workers' compensation claims in all core states.

SUPERVISORY RESPONSIBILITIES

Directly supervises 4 or more employees within the Subrogation Litigation Management team and carries out supervisory responsibilities in accordance with company policies and applicable laws. These responsibilities include interviewing, hiring, and training employees; planning, assigning, and directing work; conducting performance and salary reviews; rewarding and disciplining employees; addressing complaints and resolving problems; coaching, mentoring, and developing team members to further their skills and knowledge; creating and monitoring development plans; setting performance expectations/goals; forecasting staffing needs and planning for peak times and absences; enforcing department policies and procedures.

EDUCATION AND EXPERIENCE

Bachelor's degree from four-year college or university: Business Administration, Management or related degree, preferred; and, Juris Doctorate (JD) from an accredited law school, required. Minimum 5-8 years of related experience and/or training; or, equivalent combination of education and experience.

CERTIFICATES, LICENSES, REGISTRATIONS

Member of California State Bar required.

KNOWLEDGE AND SKILLS

Expert working knowledge of subrogation Workers' Compensation insurance industry, required. Advanced understanding of Workers' Compensation Claims principles and application. Strong understanding of personnel and performance strategies. Experience creating and implementing department-wide strategies and initiatives.

PHYSICAL REQUIREMENTS

Office environment - no specific or unusual physical or environmental demands and employees are regularly required to sit, walk, stand, talk, and hear.

COMPETENCIES

This position maps to the Director level. Additional competencies required: Insurance Industry Knowledge.

WORK ENVIRONMENT

This position operates in an office environment and requires the frequent use of a computer, telephone, copier, and other standard office equipment.
