The Marriott International Law Department, located at the Company's worldwide corporate headquarters in Bethesda, Maryland services the Company's lodging business. The Employment Practice Group ("Group"), in conjunction with the Labor, Employment and Benefits section of the Law Department, provides legal advice and counsel regarding employment issues, policies, and programs to Human Resources professionals and line and corporate staff managers with the Company's businesses.

The Vice President & Senior Counsel Employment provides legal advice and counsel regarding employment issues, policies, and programs to Human Resources professionals and line-managers within the Companys businesses. The individual in this position will be required to make judgment calls and policy decisions regarding the Companys positions and provide feedback and guidance accordingly. This position reports to the Group Leader, Vice President & Assistant General Counsel Employment Law.

Specific Job Summary and Expected Contributions

The primary responsibilities of this attorney will be:

Advising human resources departments and operating business managers on day-to-day legal concerns and consequences;

Participating in the development of legally sound policies and programs in all areas of labor and employment law, including wage and hour matters, discipline, counseling and discharge, all aspects of laws regarding discrimination, wrongful termination, defamation, emotional distress, OSHA, FMLA, reductions-in-force, union organizing efforts, drug testing issues, etc.;

Maintaining working knowledge of company policies, state and federal legislation, and bargaining agreements;

Responding to attorney letters, complaints or claims involving employment and labor-related concerns;

Conducting a risk-assessment of complaints and developing legally sound strategies for the Companys defense of legal actions;

Working with Risk Management on managing outside counsel in handling employment litigation covered by Employment Practices Liability Insurance or managing outside counsel in non-insured claims such as wage and hour cases;

Handling cases filed under the National Labor Relations Act or other labor and employment laws, as required;

Advising human resources departments and operating business managers on pending changes in employment and labor-related laws;

Creating a proactive strategy to ensure compliance with all federal/state legal requirements;

Assisting enterprise in achieving strategic goals by identifying legal consequences and issues associated with plans, and recommending alternative courses of action to achieve business objectives while limiting liability and risk;

Educating human resources managers, operating business managers and others on trends and legal actions which may affect the workplace through written materials or training seminars; and

Participating, as appropriate, in compliance audits and investigations.

Candidate Profile

Excellent academic records in college and law school, with a J.D. degree from a well-respected law school;

Active Bar membership;

Minimum of 12 years experience of substantive and applicable experience;

Broad background in providing advice and counsel to human resources and operating business managers in employment and labor-related matters;

Experience interfacing with government and/or labor and employment agencies which maintain jurisdiction over employment and labor-related legal matter;Experience as primary or second chair counsel in the litigation of employment and labor-related cases

Experience with leading-edge employment and labor-related policies, programs and systems, and up-to-date knowledge of labor and employment issues and case law;

Strong leadership skills and good judgment, and the ability to think strategically both from a business and legal perspective;

Excellent conflict management skills, and ability to influence without coercion;

Proven contract drafting and negotiating skills;

Ability to expeditiously identify and analyze issues and provide legally sound recommendations consistent with good business practices and reason;

Ability to work under pressure; and

Strong organizational and time management skills

Reporting to an Enviva Assistant General Counsel, the Senior Counsel will contribute to our compliance posture by managing a diverse and challenging array of labor and employment matters. She or he will leverage prior experience to effectively partner with Enviva's Human Resources (HR) team to (1) create internal best practices on managing employee relations matters, (2) oversee the work of outside counsel on employment-related litigation, (3) advise on external agency cases as well as internal employee relations investigations, and (4) assist the broader legal team and company as a generalist on other legal issues facing the company. Responsibilities: * Develop a deep understanding of our renewable energy business and industry and the associated developments and requirements impacting us and our employees * Understand and translate into "plain English" the legal ramifications of the full spectrum of legal issues facing the company. * Clearly and succinctly articulate those legal risks and, most importantly, present clear recommendations that ensure legal compliance and support our commercial goals * Establish processes and systems, including templates, to facilitate and automate repeatable processes that will enable our legal department to scale with the company's expected growth * Draft and review, in conjunction with the HR team, employment related agreements, including separation agreements and position statements, and work on a wide variety of HR projects * Provide advice to the HR team on employment matters, including, wage and hour compliance, disability accommodations, involuntary terminations, leaves of absence, internal investigations, and general risk assessments * Conduct or manage investigations and compliance audits; develop, implement, and oversee action plans to remedy any compliance deficiencies * Manage employment litigation and outside counsel to effectively resolve threatened or outstanding employment litigation matters and to establish best practices for prevention of future matters * Draft and deliver training programs to various internal groups and identify and communicate new legal requirements, including labor and employment law requirements * As an ambassador of the legal team, establish a rapport and working relationship with business partners across the company to encourage and continue the proactive use of the legal department * Evidence an interest and aptitude in becoming a corporate generalist Requirements Qualifications: * Demonstrated business acumen, including the ability to see the "big picture" and the relationship of very detailed and specific legal and business issues * Superior written and verbal communication skills (including presentations) and exceptional attention to detail is essential * A self-starter with a demonstrated ability to simultaneously manage a variety of assignments and competing priorities, meet deadlines, and to comfortably adapt to change and ambiguity within a growing company and a fast-paced, demanding environment * Able to make decisions quickly, but also seek guidance when appropriate * A commitment to personal and professional growth and receptivity to feedback Your Experience Includes: * J.D. from an accredited law school; must be licensed to practice law in at least one state. * At least 7 years' total relevant employment law experience in both law firm and in-house legal environments; experience working with mining or manufacturing companies preferred * Significant substantive expertise in federal and state employment law * Experience providing advice responsively and effectively, with emphasis on Title VII, ADA, FMLA, FLSA, SCA, and employment-related torts and litigation * Experience conducting investigations and responding to demand letters and government agencies, including OFCCP, the Wage and Hour Division, and the EEOC * Demonstrated ability to review, understand, analyze, and interpret employment agreements * Experience establishing credibility and rapport with executive-level management * Demonstrated ability to constructively challenge entrenched processes and influence change Location: Bethesda, MD or Raleigh, NC Travel: 25-35% Compensation will consist of a competitive salary and benefits.
