Job Title: Town Prosecutor

Job Summary

The Town of Summerville ("Town") is recruiting for the position of Town Prosecutor who will prosecute jury trials, bench trials, Domestic Abuse Court trials, conduct pre-trial hearings and prosecute code enforcement violations in Municipal Court. The successful candidate will prepare cases with Police and Code Enforcement Departments for prosecution.

The mission of the Municipal Court is to guarantee all persons accused of violations or crimes their constitutional right to a fair and speedy judicial process while preserving their dignity, as well as protecting the rights of the citizens of the Town of Summerville. We strive to provide defendants with the tools they need to successfully complete their Court requirements.

Scope of Services & Duties

  • Prosecutes all cases in Municipal Court, which includes communicating with defendants and their attorneys; communicating with police officers, code enforcement officials, witnesses and victims; working closely with the Court Administrator and Town Attorney regarding administrative matters, responding to motions of defendants; processing and preparing cases for trial; researching the law; and representing the Town in appeals from Municipal Court.

  • Performs professional legal work carrying the highest levels of volume, complexity, consequence, autonomy, and responsibility. Regularly responds to discovery requests, and drafts subpoenas, motions, notices, and proposed orders.

  • Conducts training as necessary for police officers and non-sworn staff regarding Municipal Court processes. This includes reviewing lesson plans for the training of Summerville Police Officers.

  • Identifies and recommends ordinances regarding municipal traffic and criminal offenses. Performs such other duties as are required by the Town Attorney.

  • Will work under the direct supervision of the Town Attorney and assist him as may be required from time to time, including but not limited to preparing for and assisting in civil trials.

Qualifications

  • A law degree from an ABA-accredited U.S. law school is required. Minimum of three (3) years' experience in criminal and/or administrative prosecution required. Experience in other areas of municipal law is desirable.

  • Must be licensed to actively practice law in the State of South Carolina and be in good standing with the South Carolina Supreme Court.

  • Must possess a valid driver's license.

  • Must have the ability to communicate effectively and diplomatically with Town personnel and officials, including the Municipal Judges, Municipal Court Clerk, Law Enforcement personnel, Code Enforcement personnel, defendants and their attorneys, and the general public. Prompt response to inquiries from defense attorney, law enforcement and/or the Court are required.

  • Must be able to develop a good working knowledge of the Town of Summerville Municipal Code, South Carolina Municipal Court Rules, the South Carolina Rules of Criminal Procedure and the South Carolina Rules of Evidence.

  • Skilled in legal writing and research.

  • Ability to use word processing and presentation software and to do online legal research.

  • Ability to perform with integrity; demonstrate honesty and sensitivity to ethical issues; and avoid actual or apparent impropriety and/or conflicts of interest.

  • Exercise appropriate judgment, often under pressure, consistent with the highest levels of volume, complexity, consequence, autonomy, and responsibility attending the position.

  • Will be required to attend meeting of Standing Committee and meeting of Council as necessary.

Physical Demands

This position requires the employee to sit and use hands to handle objects and reach with hands and arms; talk and hear. The employee must occasionally lift and/or move up to twenty-five (25) pounds. Specific vision abilities required by this job include close vision, distance vision, depth perception and the ability to adjust focus.

Work Environment

The work is performed in an office setting, with flexible hours when necessary.

Compensation

Compensation will be negotiated with the successful candidate. In Addition, as part of your compensation, you will come under the South Carolina Retirement system and receive free medical coverage for yourself. Coverage for your immediate family is available at your expense.

Application Evaluation

The Town Administrator and Town Attorney will evaluate the written applications and conduct interviews. Applications will be evaluated to determine which ones best meet the needs of the Town. After meeting the mandatory requirements, the applications will be evaluated in accordance with the following:

  • Comprehension of the scope of services and general approach/methodology.

  • Offeror's previous experience and past performance for services as outlined in the solicitation.

  • Experience, qualifications and availability.

Evaluations shall not be based on cost alone but will be based on the composite of the above factors. The overall best interests of the Town, in terms of cost and service provided, and response to the information requested herein will be considered in the evaluation of submitted applications.

It shall be agreed and understood that the applications are considered public documents and are subject to Freedom of Information Act.

Rejection of Applications

The Town reserves the right to reject any or all applications not in compliance with all public procedures and requirements, reject any application not meeting the specifications set forth herein; waive any or all irregularities in applications submitted and/or determine the criteria and process whereby applications are evaluated.; reject all applications; award any or all parts of any application; and request references and other data to determine responsiveness.

Town officials may, at their sole and absolute discretion, postpone or cancel this solicitation process.
