Job Description and Duties

Per CCR 249.3, this job control may be used to fill subsequent vacancies.

The hiring unit has established the following internal cut-off dates for this Job Control:

Under the general direction of the Division Director, the incumbent is responsible for enforcement of the provisions the Business and Professions Code and the California Code of Regulations as they pertain to the Division of Measurement Standards' programs. The incumbent will direct a large staff of Supervising Special Investigators, investigative, and field staff based in the Sacramento, Fresno, and Anaheim field offices in the performance of field investigations to detect or verify suspected violations of laws, rules, or regulations. The incumbent is also responsible for supporting the administrative duties of the Division as assigned by the Director. These activities include legislative and policy analysis; expense and budgetary review; drafting, editing, and reviewing documents, reports, and correspondence to internal and external stakeholders.

Supervision of Instigative Staff/Activities -

  • Supervise, direct, and coordinate the performance of supervisory and investigative staff and activities of the Division's programs, assigned to the incumbent within the Enforcement Branch. Provide leadership to program staff in the investigation of suspected violations of the Business and Professions Code and the California Code of Regulations.
  • When necessary, accompany investigative staff to sites under investigation to assure that investigative staff are using accepted practices in the enforcement of laws and regulations.
  • Review, evaluate, and approve investigative reports and provide technical assistance to investigative staff's criminal and civil filings to ensure the timely and effective conclusion of the investigation.
  • Participate in and recommend a proper course of action, and specific solutions to more complex and difficult criminal investigations involving industry or other agencies with concurrent jurisdiction.
  • Provide guidance and technical assistance in the preparation of case materials for court hearings and/or prosecutions, conducting interviews, filing of complaints, notices, and other legal documents.
  • Plan and implement marketplace surveys to evaluate compliance levels as well as the knowledge, skills, and abilities of county weights and measures officials.

Planning/Directing Program Activities -

  • Plan and direct investigators to meet the strategic plan goals of the Division, the Department, and the State of California.
  • Analyze legislation for its impact on the Division's programs assigned to the incumbent. Evaluate legislative needs and prepare proposals to meet those needs. Propose and assist in the develop of budget change proposals when necessary to meet program needs.
  • Assist in formulating regulations, procedures, policies, and practices directed at uniform interpretation of weights and measures laws.

Working Conditions

The duties of this job are performed indoors approximately 80% of the time. The incumbent occupies an office located in the Division's Sacramento office. The office is equipped with standard office furniture and equipment including a computer with various software applications and e-mail. When working outdoors, the incumbent may occasionally be exposed to extreme weather conditions, fumes, odors, and high noise levels.

Travel within the State by vehicle or air is required approximately 20% of the time in order to consult with stakeholders, support investigative and training responsibilities, and to attend meetings.

Department Information

Enforcement of California Weights and Measures laws and regulations is the responsibility of the Division of Measurement Standards. The Division of Measurement Standards is comprised of two branches: the Laboratories Branch and the Enforcement Branch. The Division's activities are designed to ensure the accuracy of commercial weighing and measuring devices; verify the quantity of both bulk and packaged commodities; and enforce quality, advertising, and labeling standards for most fuels, lubricants, and automotive products. The Division works closely with the county agricultural commissioners and sealers and their staff to ensure uniform application of the state's weights and measures laws and regulations. Ensuring fair competition for industry and accurate value comparison for consumers are primary functions of the county/state programs. The Division maintains offices in Sacramento, Anaheim, and Fresno.

Applicants MUST submit a Statement of Qualifications (SOQ) addressing the following FOUR items.

  1. Describe the depth and breadth of experience you have in leading and directing an investigative staff, conducting case preparation and working with enforcement and legal personnel, e.g., District Attorneys, regarding planned or pending legal actions. Include the outcome of the enforcement actions you were involved with.

  2. Describe the depth and breadth of experience you have developing and presenting formal training to staff or external stakeholders (developing training materials, PowerPoints, handouts, demonstrations, student assessment, etc.).

  3. Describe the depth and breadth of experience working with regulated entities, investigative and field staff and other governmental agencies regarding the interpretation and enforcement of laws and regulations. If your experience includes the enforcement of laws in Division 5 of the California Business and Professions Code list all sections that apply.

  4. Describe the depth and breadth of experience you have with writing and/or reviewing legislative proposals, promulgated regulations via rulemaking, and conducting bill analysis.
