Responsibilities

As a Sr. Claims Litigation Specialist

  • Construction Defect, you'll primarily be responsible for the investigation, evaluation, and resolution of complex Construction Defect (CD) claims, applying your claims experience and analytical skills to make informed decisions and bring claims to resolutions.

You'll also be responsible for the quality handling and resolution of complex, high exposure General Liability claims in a timely and professional manner with emphasis on providing quality service while controlling expenses. Your knowledge would be leveraged to handle claims with the most complex coverage issues, catastrophic injuries, intellectual property matters, employment practices liability matters, and serious litigated matters frequently reserved more than $200k. You may on occasion handle some Commercial Auto claims which have significant injuries however the Commercial Auto handling is limited.

We'll count on you to:

  • Working with strong technical expertise and limited supervision, the Senior Claim Specialist-Litigation effectively manages a caseload of Major Case Construction Defect (CD), General Liability, Commercial Auto (including UM/UIM) and other Complex Claims through coverage analysis, investigation, damage evaluation, reserving, and resolution.

  • Develop positive business relationships with panel counsel and work with them closely to develop cost efficient approaches to the litigation process and develop action plans to manage cases to early conclusion.

  • Prepare and present large loss reports.

  • Establish timely and accurate claim and expense reserves.

  • Negotiate and convey claim settlements within authority limits.

  • Attend mediations and trials.

  • Draft timely Reservation of Rights, Coverage Disclaimer, Tender Response Letters/Draft Tender Letters to others, along with other complex correspondence.

  • Understand how to interpret sub-contract agreements.

  • Maintain an effective diary system and document claim file activities in accordance with established procedures.

  • Manage file inventory to ensure timely resolution of cases.

  • Handle files in compliance with state regulations.

  • Provide excellent customer service to meet the needs of the insured, agent and all other internal and external customers.

  • Perform administrative functions such as document preparation, expense accounts, time off reporting, etc. as required

Qualifications

  • 4-year college degree or equivalent work experience.

  • 2-3 years handling Completed Operations Construction Defect (CD) claims.

  • 5+ years prior experience handling 3rd party GL/Commercial Auto litigation claims more than $200k.

  • Proven ability to identify and address coverage issues, complete investigations to determine exposure, set timely reserves and develop detailed action plans.

  • Excellent interpersonal, communication, and collaboration skills.

  • Excellent negotiation, time management, and organizational skills.

  • Knowledge of tort and contract law.

  • Effective presentation skills.

  • Working knowledge of legal billing software, claim systems, spreadsheet and word processing software applications.

  • Self-directed with the ability to work independently.

  • Adjuster licenses in the states of NC, SC, and GA
