Edwards Lifesciences is seeking an experienced Employment Law Attorney to serve as counsel responsible for labor and employment law and other matters as may be assigned. Essential Job Functions:

  • Legal support in connection with labor and employment issues, including:

  • employment agreements and corporate employment policies.

  • employee mobility issues, including analysis/enforcement of non-compete, non-solicit, confidentiality, and trade secret provisions in employment agreements.

  • wage and hour requirements.

  • workplace accommodations.

  • leaves of absence.

  • employee classification issues.

  • contingent labor management.

  • workers' compensation.

  • compensation and equity issues, including compensation plan review and pay equity analysis.

  • Partnering closely with the Human Resources organization and business leaders providing advice and counsel on a number of employment-related issues (e.g., disciplinary actions, terminations, other employment actions)

  • Conducting trainings for Human Resources and managers on a variety of employment-related topics (e.g., accommodations and leaves of absence, workplace investigations).

  • Strategic management of employment-related litigation and claims (including investigation of agency charges and drafting position statements, engaging and managing outside counsel, and negotiating resolution of disputed claims).

  • Responding to 3rd party subpoenas.

  • Providing legal support in the area of commercial contract review, M&A transactions and integrations, and international employment matters.

  • Working on special assignments as needed; developing a close working relationship with senior managers; leading working teams containing members with diverse backgrounds and perspectives to achieve strategic goals of the business; and facilitating communications with, and building consensus among, colleagues and management.

  • Routinely interacting with management at various levels within the operating businesses.

  • Collaborating effectively with employees at all levels of the corporation; analyzing problems and presenting solutions, alternatives and risk analyses to management; gaining the confidence and respect of management, and driving projects to completion.


Education / Skills / Experience:

  • JD and admission to practice law in the State of California is required.

  • Must have at least 4 years of experience (with in-house experience strongly preferred), with emphasis in labor and employment advice/counseling and employment litigation/claim management.

  • Strong writing, editing, and presentation skills are a must.

  • Mature, independent judgment and excellent communication and interpersonal skills.

  • Ability to think strategically and to formulate creative and practical legal business solutions is critical.

  • Ability to multi-task and prioritize issues.

  • Must be capable of working independently and as part of a team.

  • Proficiency with MS-Office Suite applications (e.g., Word, Excel, Outlook, PowerPoint).

Requisition ID: 49227 Senior Corporate Employment Counsel As an integral member of the legal team, you will partner closely with the human resources organization providing employment and human resource related legal services and advice in support of executing Skyworks' global employment policies and practices. This will include legal services such as advice and counsel on the full range of employment issues (employee discipline, policies, leaves and accommodations, investigations, separation agreements), optimizing litigation results (agency, individual and class action), and provide employment law training/skills development and projects. * Become a trusted advisor to the business and serve as the primary legal support for day-to-day employment and HR related legal matters. * Work with human resources team to evaluate current employment practices, policies, and processes to assess and execute priorities, and ensure compliance. * Develop new policies and procedures, online and in-person training on employment-related matters and programs, and smart and practical guidance for our global business teams * Partner with human resources team to investigate and respond to internal complaints, demand letters, legal complaints, administrative complaints, audits, and other employment-related inquiries. * Provide advice and counseling on a broad spectrum of employment law issues, including: recruiting, employee relations, performance management, leaves of absence and accommodations, wage and hour, internal investigations, compensation and benefits, privacy, and contingent workforce issues. * Coordinate response to charges from state and federal agencies, including subpoenas and similar requests for employment-related records. * Keep general managers and HR informed of significant labor and employment trends and decisions, legislation and rulings. * Manages both employment and general litigation matters, including recommending outside counsel, developing case strategies and budgets, discovery responses, deposition preparation of client, and final favorable resolution * Analyze and recommend strategies and/or practical solutions to achieve business goals while maintaining acceptable level of risk. * Assist with corporate governance matters and legal structures * Reduce external counsel expenditures where appropriate, particularly regarding employment matters. * Conduct audits, classification reviews, and support other compliance efforts. * Ensures compliance with all applicable laws, rules and regulations * Reports to the Senior Vice President, General Counsel. Qualifications: * JD and 8-10 years of experience required * 5+ years of employment litigation experience preferred * In-depth knowledge of U.S. federal and state employment laws and regulations including NLRA, SCA, FLSA, Title VII, Americans with Disabilities Act, Family Medical Leave Act, EEO laws, wage and hour and other federal and local laws affecting the employer-employee relationship and federal and state prevailing wage laws * General knowledge of international employment laws with ability to work with global local outside counsel * A J.D. from an accredited law school with strong academic credentials * Licensed and in good standing to practice law within California. Knowledge, Skills and Abilities: * Highly ethical * Thorough and current knowledge of relevant state and federal employment laws and regulations. * Experience investigating and responding to government agency complaints. * Excellent legal research skills * Solid knowledge/understanding of human resources practice principles. * Strong interpersonal, critical thinking and problem solving skills with demonstrated ability to analyze, identify, solve problems using sound judgment, develop and implement effective solutions * Strong communication skills with the ability to clearly and effectively convey information to individuals or groups.
