Job Description:

This position is responsible for the overall implementation and direction for the assigned area of the estimating functions to provide services, procedures, and methods for the timely and accurate issuance of estimates and supporting documentation to the client and project management. In responding to estimating requests, is responsible for ensuring that departmental and company requirements are met. This position may direct the quantitative development of material, labor, and subcontract take-offs, as well as the coordination of information among Engineering, Procurement, Construction, Commissioning and Maintenance. This individual will be focused on working with the multi-projects group, leading estimate development of sustaining capital projects for the local oil refineries. Potentially this position may lead the development estimates for large grass roots oil & gas, renewable power, and/or chemical facilities.

  • Develop the estimate plan and coordinate estimate development with the project team

  • Lead the development of the total project estimate; detailed and/or conceptual

  • Prepare the total Project Basis of Estimate

  • Prepare the Estimate Risk Analysis and make cost contingency recommendations

  • Analyze and make independent recommendations regarding solutions to problems with varying complexity in accordance with organization and/or project objectives and guidelines

  • Other duties as assigned

Preferred Qualifications

  • Seasoned expertise to ensure that all pertinent information is updated in relation to the present scope of work

  • Should be involved with an Estimating professional society

  • Minimum of five (5) years of experience using Industry recognized estimating systems

  • Minimum of two (2) years of field experience, preferably in project controls, construction, contracts, or estimating

  • Demonstrate strong technical ability, combined with communicative skills, to lead estimate development

  • Knowledgeable about Lump Sum and/or Cost Reimbursable estimating

  • Knowledgeable about Self-Perform and/or Construction Management Execution

  • Knowledgeable about internal Cost Systems, Progressing Systems, Level I and II Schedules, Work Breakdown Structures and Project Status Reports

  • Recognized as being proficient in the following areas:

Direct Field Costs, Indirect Field Costs, Escalation, Selling an Estimate, Benchmarking and Unit Rates for Key Commodities, Insurance, performance bonds & letter of credit costs, Estimate Plan, Basis of Estimate, Use of Allowances, Cost Contingency, Productivity Worksheets, Craft Mix and Crew Mix, Data Analyst, Comparison Analyst, Input into and Use of Historical Data, Procurement including a comprehensive understanding of Purchase Order, Budget Quotations and "Procurement Action Request for Proposal" (PARP) and "Procurement Action - Request for Quotation" (PARQ) work processes

  • Recognized as being familiar, but requiring guidance and supervision in the following areas: Currency fluctuation and tax costs

  • Good analytical and computer skills

Role Overview Reporting to the General Counsel, the Senior Corporate Counsel – License Compliance and Litigation position will be a dynamic role with responsibilities across the license compliance team, sales and the legal department. Among other duties, the Senior Corporate Counsel position will be directly responsible for formulating and actively driving strategies for the protection of Quest's intellectual property as well as the resolution of complex, high-value customer negotiations and associated litigation. Responsibilities * Manage complex negotiations and worldwide litigation matters relating to contractual and copyright disputes as well as other inbound and outbound litigation for the company. * Manage worldwide patent, trademark copyright portfolios * Responsible for preparation of discovery, review of pleadings, and formulation case strategy. Provide direction and oversight on electronic discovery collection, holds, and compliance. * Review and revise license models and form templates to better align with business goals. * Provide direction to business partners on accomplishing the business objectives while managing legal risk. * Provide counsel and develop and conduct legal training for business partners in the areas such as privilege, document creation and retention, and other areas as requested. * Assist in preparing and managing depositions. * Manage outside counsel, coordinate litigation strategies, and tightly control litigation-related costs. * Review and execution of NDAs and related agreements * Assist in other substantive legal areas and work with members of legal leadership, other attorneys and staff on departmental matters as needed. Qualifications * At least 5 years of experience as a practicing attorney with experience in a top law firm or in-house. * Solid working knowledge of trademark, copyright and contract law * Experience negotiating commercial transactions, preferably in the software space * Litigation experience handling IP litigation through all phases (pre-trial, trial, appellate, settlement). International experience preferable. * Demonstrated success at providing strategic counseling to business partners that takes into account legal considerations along with business goals * Experience interacting at a senior level with business management teams a plus * Up to 15% travel required.
