Responsibilities

New opportunity based in Billerica MA within the Tax Team for a Sr. Director of Transfer Pricing to develop and manage the global transfer pricing function, policies, pricing, documentation, and compliance in accordance with tax laws and regulations. This highly visible global position reports to the SVP of Corporate Tax and works closely with the Tax Planning and non-tax business teams on broad policy and/ or specific issues with transfer pricing implications. The Sr. Director of Transfer Pricing will also direct transfer pricing of products, services, intangibles and financial products throughout the intercompany value chain; takes a proactive role in monitoring and directing all inter-company transfer pricing to achieve year-end legal entity profitability targets; work closely with Tax Accounting to ensure mix of income forecast used in the effective tax rate model is in line with forecasts used by Transfer Pricing to establish product pricing and year-end true-up adjustments; and holds responsibility for continuous improvement of processes related to tangible product price establishment and execution, legal entity profitability monitoring, adjustment and documentation.

  • Oversee Transfer Pricing planning on a global basis

  • Analyze current and future transfer pricing strategies to help mitigate risk, optimize efficiency and facilitate future business operations

  • Develop and maintain global transfer pricing policies and US documentation.

  • Provide oversight/governance for transfer pricing documentation to meet country specific reporting requirements outside of the US.

  • Communicate transfer pricing policies and support implementation across various business units and regions.

  • Monitor compliance with transfer pricing policies and advise on adjustments that may be required.

  • Ensure compliance with US and non-US transfer pricing rules as they may impact the broader tax considerations of the company.

  • Support Finance, Operations and IT in transfer pricing policy implementation in systems and business processes.

  • Manage relationship with outside service providers.

  • Assist and Interface with Tax Accounting on interim and annual tax provision and reporting matters.

  • Conduct financial and economic analyses and advise on intercompany transactions.

  • Oversee analysis and development of IP financial valuation models

  • Work with internal tax team to help establish audit defense and support for US and non-US locations as necessary

  • Provide tax controversy support as it relates to transfer pricing matters including responses to tax authority inquires.

  • Research and provide advice on changes in tax law related to transfer pricing and the tax implications of proposed transactions.

  • Work with Controllers to establish and manage Cost Sharing/R&D strategies, I.P. (Intellectual Property) management and issues related to logistics and procurement activities

  • Address service charges and management fees

  • Educate appropriate personnel in Finance and businesses regarding Transfer Pricing requirements and risks

  • Support direction of a team of transfer pricing managers similarly responsible for financial Supply Chain management and transfer pricing establishment and documentation

  • Monitor legislative changes in tax laws related to transfer pricing that may impact the company's tax positions and/or compliance requirements.

  • Follow developments in US and OECD tax/transfer pricing regulations and identifies issues or opportunities arising from those developments

  • Perform other duties as required.

Qualifications

  • Minimum of 10+ years of combined public accounting and/or corporate transfer pricing work experience including 5+ recent years' industry planning projects involving IP transfers and principal models along with recent management, team training and development. Life Sciences experience preferred.

  • Bachelor's degree in Economics, Finance, Accounting, Business or related major. MBA, JD/LLM, and/or Master's degree in relevant field of study preferred.

  • Deep knowledge and experience conducting functional analysis and preparing transfer pricing documentation

  • Demonstrated involvement in the implementation and maintenance of tax efficient supply chain structures

  • Experience working with IT, operations and finance in developing system solutions to enable transfer pricing requirements

  • Advanced knowledge of tax accounting principles and experience with multiple systems (e.g., Hyperion, SAP, Oracle, etc.) with unquestioned integrity in the application of accounting and tax standards

  • Advanced business acumen and judgment with proven understanding of corporate income tax matters and industry issues

  • Proven experience with identifying, analyzing and communicating complicated transfer pricing and tax issues in terms of the impact on business operations and results

  • Demonstrated experience with identifying global and domestic transfer pricing issues and opportunities

  • Superior project management and leadership experience involving large multi-functional teams; ability to plan, monitor, and manage to deadlines

  • Strong written and verbal communications skills, particularly around the ability to translate complex technical analyses to CFO and other non-tax employees

  • Excellent organizational and leadership skills to manage Tax and cross-functional teams engaged in transfer pricing work

  • Proven self-starter with ability to work effectively in cross-functional teams to identify and constructively resolve concerns

  • Possesses executive presence to represent Tax in high visibility settings along with critical Finance competencies such as: People Management, Collaboration & Teamwork, Influence & Communication, and Drive for Results, Business Insight, Project Management & Process Improvement, Decision Making, Critical Thinking Analysis and Finance Expertise.

  • Maintains effective external industry and professional network.

  • Excellent verbal, written, computer, technical, proposal, and interpersonal communication and presentation skills, advanced technology skills and proficiency with MS Office Suite

  • Valid Driver License in good standing, issued by resident state required

  • U.S. Citizenship or U.S. Permanent Resident status required.

  • Maintain a valid passport with flexibility for domestic and international travel

  • May be required to pass security clearance investigation.

Reporting to the Chief Tax Officer, the Global Tax Director will ensure the tax function realizes enterprise value by leveraging Bruker's existing operational profile. Success will be achieved through developing and maintaining effective relationships with global leaders and experts in various business units. * Partner with the Chief Tax Officer to lead global tax planning initiatives that optimize tax posditions within Bruker's non-US operational structure. * Assess global mobility of business functions and develop planning recommendations. * Place emphasis on developing and implementing enhancements to Bruker's Swiss Principal operating model. * Secure tax incentives from jurisdictions experiencing operational growth. * Demonstrated strategic financial leadership related to liquidity, working capital, cash forecasting, capital structure planning, and creating shareholder value. * Perform functional and other BEPS-sensitive analyses. * Assess and develop optimal structures around Intellectual Property (IP) ownership and services. * Provide support for Merger and Acquisition initiatives, including due diligence and structuring for contemplated transactions. * Lead and guide the satisfactory resolution of tax controversies, including developing documentation and memoranda that support positions taken on filed returns. * Manage treaty-based dispute resolution processes, including Advance Pricing Agreements and Mutual Agreement Procedures. * Provide tax support and optimization globally to business systems change and process standardization initiatives. * Perform other duties as required. Qualifications * Bachelor's Degree in Accounting or Finance, advanced degree (MST/MBA/JD) preferred * Minimum of 10 years' work experience in public accounting and/or a large corporate tax department including 5+ years of progressively increasing responsibility and global leadership work experience. * Broad international tax work experience, specifically with Germany and Switzerland. * Demonstrated knowledge and expertise with country, federal, state, and local tax laws and regulations. * Advanced proficiency in ACS 740 and other tax-related reporting rules, including Sarbanes-Oxley requirements. * Proven experience and working knowledge of the SAP ERP and consolidation systems. * Advanced proficiency with OneSource tax reporting platform desired. * Outstanding business analysis, financial planning and reporting skills that generate business insights which add measurable value. * Effective at coordinating global change management initiatives with teams to achieve desired results.
