Unit Description

Sodexo is currently searching for a Senior Counsel to to focus on Labor and Employment law.

There is a strong preference for the Senior Counsel to be located in Southern California. Lawyer located elsewhere in California can expect significant travel to Southern California.

Act as labor and employment counsel to national corporation handling wide variety of matters affecting over 100,000 employees, focusing on California (and other West Coast) employment law matters.

ESSENTIAL FUNCTIONS:

Provide Labor and Employment Law Counseling

  • Advise clients on the legal risks of potential personnel actions, including disciplinary actions and terminations;

  • Advise clients on legal compliance with federal and state employment statutes, and serve as a subject matter expert on California employment laws;

  • Advise clients on achieving desired employment actions while minimizing legal risk; and

  • Advise clients on dealing with difficult or poorly performing employees.

Manage Outside Counsel to Defend Employment Litigation

  • Assign litigation to appropriate outside counsel;

  • Coordinate defense with outside counsel, ensuring compliance with Employment Law Group defense practices;

  • Provide information and documents as requested and/or which facilitate defense;

  • Oversee litigation and provide guidance on conduct of litigation;

  • Monitor and approve legal fees;

  • Assist in negotiation of settlements; and

  • Assist in trial of litigation, if necessary.

Supervise One or More Wage and Hour Compliance Specialist(s)

  • Oversee Specialist who analyzes rates of wage and hour compliance and will take corresponding measures to enhance compliance rates.

Respond to Attorney Demand Letters

  • Review and investigate allegations contained in letters from attorneys demanding compensation for former or current employees;

  • Respond appropriately (in writing, orally) to all demand letters; and

  • Where appropriate, negotiate settlements of claims in demand letters.

Represent Company Before Federal and State Agencies Such as the Department of Labor and California Division of Labor Standards Enforcement on Matters Such as Wage and Hour Issues, Claims of FMLA or OSHA Retaliation)

  • Investigate and defend charges of unlawful conduct filed with various federal and state agencies;

  • Provide written response, where necessary, to claims of unlawful conduct; and

  • Represent Sodexo in hearings, as necessary, on claims of unlawful conduct.

Report to Executives on Formal Labor and Employment Matters

  • Prepare quarterly reports on all formal labor and employment matters (e.g., litigation, demand letters); and

  • Evaluate claims and provide risk analysis and liability assessment on matters.

Develop Personnel Policies and Key Employment-Related Personnel Documents

  • Assist in development of written employment policies and practices;

  • Advise on ways to adjust to and manage exposure to new or increased legal risks, e.g., wage and hour compliance; and

  • Assist in development of separation packages and settlement agreements, as necessary.

Train and Educate Human Resources and Operations

  • Conduct training seminars on legal issues, including sexual harassment, equal employment opportunity, wrongful discharge, wage and hour, litigation and charge avoidance; and

  • Provide periodic updates to clients on significant developments in the law.

SECONDARY RESPONSIBILITIES:

Assist in Investigations

  • When requested, assist Human Resources, Operations, Security or EEO Representatives in conducting investigations, typically of discrimination or harassment claims

Assist in Defense of Administrative Discrimination Charges

  • Assist in strategy for defense of EEO discrimination charges, as needed;

  • Assist in conciliation of administrative discrimination charges and assist in settlement discussion of same; and

  • As necessary, represent Sodexo before the state anti-discrimination agency regarding administrative discrimination charges.

Advise on Interpretation of Collective Bargaining Agreements

  • Where requested, assist Labor Relations Department in interpreting collective bargaining contracts.

Participate in National Labor Relations Board Matters

  • As may be requested by the Sodexo labor lawyer, assist in defense to unfair labor practice charges, including investigation, research and argument.

QUALIFICATIONS/REQUISITE SKILLS:

  • Juris Doctor degree

  • High degree of independent judgment and responsibility

  • High level of expertise in labor and employment law; with subject matter expertise relating to California laws

  • Proven ability to recommend creative solutions to complex business problems with employment law implications

  • Excellent verbal and written communication skills

  • Capability to analyze complex written and verbal information

  • Ability to travel as needed

  • Substantial knowledge of California wage and hour laws, and significant experience with wage and hour laws generally

Senior level attorney providing ongoing in-house counsel and legal advice to managers. Responsible for handling a variety of highly complex assigned legal projects and cases. Evaluates case liability and financial exposure for appropriate compliance. May supervise outside legal counsel.

Qualifications & Requirements

Basic Education Requirement

  • Juris Doctorate (J.D.) or LL.M. (Master of Laws) Basic Functional Experience

  • 7 years of experience as a practicing attorney

The Counsel, Data Protection & Privacy - Americas position will provide legal risk assessment and compliance advice relating to Americas data protection and privacy law, including in connection with the development and maintenance of CBRE Group's Global Data Privacy and Protection Program. This individual will report into the Legal Director, Data Protection & Privacy - Americas. Responsibilities will be tailored at a high level to the requirements of US, Canadian and Latin American data protection and privacy law, as well as the GDPR. This role will require coordination across multiple regions and continuous engagement with various levels of the company's personnel, including senior members of HR, Legal, IT, and Compliance. ESSENTIAL DUTIES AND RESPONSIBILITIES Assess legal risks and advise managers, senior leaders and operational teams on matters involving the processing of personal data to help maintain compliant data protection and privacy practices across the Americas. Perform data protection impact and privacy-by-design assessments and advise on and develop control frameworks to enable compliance with data protection and privacy laws, focusing on the Americas, while enabling the development of new technologies and execution of business initiatives. Provide legal advice on compliance with CBRE's legal obligations in responding to data subject rights requests. Develop and provide training to various business and operational teams regarding data protection and privacy compliance. Develop and maintain data protection and privacy guidelines, playbooks, agreement templates, and other resources to enable and support compliance with Americas data protection and privacy laws. Advise on new and emerging legal and regulatory developments impacting data privacy and data security, including identifying trends and potential impacts on emerging technologies and business activities. Support merger and acquisition activities by conducting privacy compliance assessments. Advise CBRE's Records Manager on legal retention and deletion requirements applicable to complex data flows across the data lifecycle and maintenance of records retention schedules. Other duties as may be assigned. EDUCATION, BAR ADMISSION and EXPERIENCE Juris Doctorate (JD) from an accredited law school and graduation in the top 25% preferred. License or authorization to practice law in New York, Illinois, or California and Bar membership in good standing with four to six years' experience, preferably in the area of data protection and privacy law. Demonstrable data protection and privacy law and program management skills, with an emphasis on CCPA, LGPD, CAN-SPAM, HIPAA, GDPR, e-Privacy Directive, and other applicable laws strongly preferred. Experience providing risk-based and pragmatic solutions to outstanding data protection and privacy compliance issues. Knowledge of data and information governance and associated policies. Knowledge of IT, web, and mobile technologies (especially those used in the collection, storage and analysis of data) and their privacy and data security implications preferred. Knowledge of data science, analytics, and ethics preferred. Demonstrated ability to work autonomously as well as part of a team while managing multiple priorities. Experience working in-house at a large, multi-national corporation across multiple business lines and functions preferred. Knowledge of the commercial real estate services business is helpful. Team-focused work ethic that emphasizes respect and collaboration over management hierarchy. COMMUNICATION SKILLS Ability to translate legal advice into actionable policies, processes and programs and communicate complex data protection and privacy compliance obligations in a concise, straight-forward manner to non-lawyers both orally and in writing. Excellent oral presentation skills are required. REASONING ABILITY Ability to solve advanced problems and deal with a variety of options in complex situations.
