Amgen is searching for a Senior Counsel Patent Biosimilars in our Intellectual Property and Litigation group. This role can be based at Amgen's corporate headquarters in THOUSAND OAKS, California or at Amgen's sites in SOUTH SAN FRANCISCO, California or CAMBRIDGE, Massachusetts. Preferably, this role will be based in THOUSAND OAKS.

The Senior Counsel will develop, implement and execute a market access strategy for Amgen's biosimilar molecules, including freedom-to-operate analyses for drug substance, drug product, formulations, processes and labeled indications.

The Senior Counsel will work in all aspects of intellectual property, especially in identification of relevant patents, conducting searches for prior art, analyzing third party patents, developing persuasive legal arguments, drafting opinion, working with experts, and performing other pre-litigation activities.

Other responsibilities for the Senior Counsel could include related worldwide patent procurement, trademark and copyright matters, due diligence, and patent litigation support.

The Senior Counsel will work individually, in legal teams and in cross-functional business teams.

Basic Qualifications:

J.D. degree or LL.M. degree from an accredited law school, admission to practice law in a U.S. jurisdiction and four (4) years of experience practicing intellectual property law


Registered to practice before the U.S. Patent and Trademark Office.

Preferred Qualifications:

10+ years of experience practicing patent or intellectual property law

Experience in all aspects of U.S. and foreign intellectual property law relating to biotechnology at a law firm or biotechnology/pharmaceutical corporation

Experience in adversarial proceedings such as oppositions, IPRs, other post-grant proceedings, or litigation in the United States or other jurisdictions

An advanced degree, such as a Master's or Ph.D., or research experience, in molecular biology, cell biology, microbiology, biochemistry, genetics, immunology, structural biology, pharmaceutics, chemical engineering or biology

Excellent judgement, analytical skills, legal drafting and oral and written communication skills

Strong management skills as well as a strong client service focus and the ability to work independently and in teams; ability to navigate through ambiguity, ability to work efficiently, to prioritize workflow, to meet demanding deadlines, and to manage multi-dimensional projects in a fast-paced environment

As an IP team member, this individual is versatile and passionate in handling new ways to craft IP positions & protection for groundbreaking innovation. You will be working with scientists, attorneys, patent agents, and staff across a dynamic & diverse global organization pushing the boundaries of what is possible in a highly competitive industry. This position will be located in our South San Francisco campus and will report to the lead of our Biosimilars, Manufacturing & Litigation Readiness team. Position Scope and Key Responsibilities: * Lead global IP strategy and contribute to patent enforcement strategies for a Genentech product currently facing biosimilar entrant challenges * Perform BPCIA risk evaluation & deploy mitigation strategies across product portfolio * Drive strategic IP procurement, management, and enforcement of global intellectual property rights including drafting & prosecuting patent portfolios, licensing transactions, due diligence assessments, freedom-to-operate, infringement and validity analyses, and risk evaluation and mitigation strategies individually and in cross-functional global teams * Provide IP diligence, advice and strategy for IP transactions with transactional legal group to business development, research and intellectual property functions and the global manufacturing business in support of local and globally-driven collaborations, licenses, mergers, acquisitions, equity investments, and divestitures * Identify and support strategic opportunities in Legal to collaborate across practice groups and with Roche colleagues to innovate and better serve the business * Serve as a strategic IP advisor to senior business leaders * Regularly anticipate future challenges and risks to the company and innovate to find solutions and create business value in response to a highly competitive, dynamic marketplace that includes innovators & biosimilar competitors * Foster strong, collaborative relationships with stakeholders across global sites and create efficient and effective processes for communicating, advising and working with stakeholders at all levels of the organization * Direct & manage outside counsel, related budgets and, where applicable, negotiate rates, project fees, and timelines * Cultivate a culture that reflects a strong commitment to diversity, inclusion and community Critical Competencies: * Experience & expertise in global patent portfolio preparation, prosecution, and enforcement for large molecule therapeutics, modalities and related technologies that are in development or being commercialized * Experience & expertise in global adverse patent proceedings such as IPRs, reissues, reexamination, post-exam, and opposition practices * Expertise in opinion practice with respect to patentability, validity, and freedom to operate * Exceptional communication skills evidenced by consistent highly articulate oral and written communication to all levels of an organization as well as a willingness to listen & learn from others * Demonstrated excellent judgment, pragmatism, and negotiation skills * Proven track record as an adaptive and results-oriented performer.
