Position Overview

Under direction, serves as Senior Attorney for the Health Related Prosecutions Unit. Investigates and prosecutes violations of assigned acts, rules, regulations and judicial decisions. Travels to conduct formal and informal hearings on complaints alleging violations. Assists superior in prioritizing, reviewing, and assigning cases. Institutes licensure disciplinary proceedings in the Department against a licensee accused of irregular practice. Enters data on personal computer and/or laptop computer concerning prosecution activities. Conducts research and provides expert legal advice to professional licensing and disciplinary boards. Consults, meets, and cooperates with other State and Federal agencies.

Essential Functions

Investigates and prosecutes violations of assigned acts, rules, regulations and judicial decisions, including but not limited to the Pharmacy Practice Act, the Nurse Practice Act, the Dental Practice Act, and all Cannabis Acts, with an emphasis on Controlled Substance Cases:

  • Assists in the development of legal procedures affecting Health Related Prosecutions.

  • Prepares and assists in preparation of legal research dealing with sophisticated legal concepts or remote points of law; usually such projects demand the utmost speed without diminution of form or content of results.

  • Travels to monitor and direct pre-hearing processes, including but not limited to discovery, status or progress call, party appearances; definition of issues.

  • Regulates and controls the timely and efficient resolution of disciplinary cases which includes negotiating and drafting settlement agreements.

  • Interacts with parties, the public, and other Department representatives to assure a fair, complete and unbiased administrative process.

  • Manages large a case load and possess sufficient working knowledge of disciplinary violations in the assigned acts and rules.

  • Reviews and analyzes public complaints with corresponding investigations which may include investigative reports, inspection reports, video, witness statements and medical records, in light of administrative regulatory violations which may result in public discipline.

  • Institutes licensure disciplinary proceedings in the Department against a licensee accused of irregular or unprofessional practice under assigned acts, with an emphasis on controlled substance cases

Travels to conduct formal and informal hearings on complaints alleging violations under assigned acts, with an emphasis on Controlled Substance cases:

  • Assimilates the evidence.

  • Prepares written legal pleadings including notices, complaints, consent agreements, and orders.

  • Interviews witnesses, examines documentary evidence, acquires an expert opinion, analyzes and appraises facts and evidence often of a sensitive and confidential nature.

  • Summarizes cases, reports findings, and makes recommendations to superior as to whether or not license disciplinary proceedings should be initiated by the Department against a licensee accused of irregular practice or whether criminal referral should be made with the appropriate law enforcement body against an unlicensed practitioner.

  • Drafts motions, responses, and replies relating to disciplinary cases being litigated.

  • Analyze video and documents evidence including medical records, and controlled substance inventories, such as prescription monitoring program (pmp) information.

  • Schedules, corresponds and meets with Board members and parties for informal hearings. Prepares discovery and exhibits in advance for Board review.

  • Travels to conduct these duties.

Essential Functions (cont)

Assists superior in prioritizing, reviewing, and assigning cases within the assigned acts, with an emphasis on Controlled Substance related cases:

  • Serves as senior attorney with expertise in Controlled Substance related cases.

  • Serves as a resource for attorneys and clerks in Health Related Prosecutions and for the Department.

  • Meets regularly with profession coordinators and investigators with an emphasis on the Pharmacy coordinator and investigators.

  • Attends outside events and meetings relating to the assigned Acts with an emphasis on pharmacy and controlled substances.

Institutes licensure disciplinary proceedings in the Department against a licensee accused of irregular practice under assigned acts, with an emphasis on Controlled Substance cases:

  • Prosecutes the accused in Departmental hearings before Committees/Boards and acts as advisor to the Committees/Boards on the admissibility of evidence and procedural inquiries.

  • Prepares a written report of findings, recommendations to the Director; as well as conclusions after board action and represents the Department at hearings or in court.

  • Assists with the preparation of Department Record and Answer.

  • Institutes criminal and/or injunctive proceedings against unlicensed practitioners by referring and presenting the case to the State's Attorney of the appropriate county or the Attorney General

Enters data on personal computer and/or laptop computer concerning prosecution activities

  • Enters data into the Department's case tracking system.

  • Updates status of cases with action items or attorney notes.

  • Compiles data and documentation in support of requirements and projected requirements of prosecution activities.

  • Verifies documentation/reports for accuracy.

Conducts research and provides expert legal advice to professional licensing and disciplinary boards in the interpretation of applicable statutes, proposed rules, regulations and changes in applicable legislation

  • Assists boards with interpretation of statutes and correct procedures in licensing and in deliberations regarding disciplinary action.

Consults, meets, and cooperates with other State and Federal agencies, the Illinois Attorney General's Office, State's Attorney's Offices, and U.S. Attorneys Offices regarding cases of a sensitive and confidential nature involving criminal and/or administrative prosecution, transfer and use of evidence, and court appearance scheduling:

  • Compiles relevant evidence and material for referrals to other State and Federal agencies

  • Appears in court at the trial with a State's Attorney or an Assistant Attorney General.

Performs other duties as required or assigned, which are reasonably within the scope of the duties enumerated above.

Minimum Qualifications

  • Requires graduation from a recognized law school.

  • Requires the possession of a license to practice law in Illinois.

  • Requires three years professional experience in the practice of law in the area of administrative and regulatory law.

Preferred Qualifications

  • Prefers at least four years of progressive experience in conducting trials.

  • Prefers at least four years of experience writing legal documents for presentation in judicial or quasi-judicial proceedings.

  • Prefers at least four years of experience working in a judicial or quasi-judicial setting, interacting regularly with staff, other attorneys, litigants and the general public.
