As Product Counsel, you'll have a broad range of responsibilities providing legal guidance on product development projects. You will partner with our innovators to develop new technologies while managing legal risk and ensuring regulatory compliance for our Cash product workstreams and Square's consumer lending products. You will also be called upon to negotiate complex commercial relationships that contribute to our products success. As we expand our offerings, your ideas and contributions will make an immediate impact.

You can work in San Francisco, Oakland and New York.

You Will:

  • Provide guidance to product and engineering teams on issues related to all products and features throughout the entire product development lifecycle

  • Draft and negotiate commercial and intellectual property agreements affecting the company's products and services

  • Remain up-to-date on relevant industry, consumer protection, advertising, IP, and privacy laws and regulations to provide an ongoing ability to provide sound compliance advice

  • Draft terms of use, product policies, and disclosures, and implement related processes

  • Provide ideas and insights into how the company can work within the law to create amazing product experiences for its customers

You Have:

  • 5+ years of combined, relevant experience in law firms, governmental agencies, or in-house legal departments

  • Familiarity with launching products and advising on the legal and regulatory aspects of product development in the technology space

  • Excellent commercial negotiation and drafting skills

  • Fluency translating legal advice into actionable guidance for creative products and collaborators

  • Organize and manage projects effectively

  • Work in an evolving and growing environment that is prone to changes

  • Use sound and practical business judgment and creativity to solve problems

  • A Juris Doctor (JD) degree and active membership in at least one state bar

  • Experience with some or all of the following laws and regulations and/or regulatory fields: Lending servicing and collections, TILA/Regulation Z; ECOA/Regulation B; FCRA; BSA/AML; EFTA; ECOA, MLA, SCRA, red flags and GLBA.

About the Role LendingClub's Legal Department is seeking an attorney for the position of a Product Counsel in San Francisco, CA. You will be an expert in contract drafting and review as well as familiar with consumer finance laws and regulations and can anticipate and deliver on the needs of our various personal loans products. You will be comfortable working with cross-functional teams and have the flexibility to manage a wide range of innovative projects proficiently. A strong personality with good soft skills, the ability to truly flex between working independently and as a team is vital. What You'll Do * Support the business in its offering of credit products for its personal loans line of business; * Partner with the business in streamlining processes; * Partner with issuing banks for ongoing monitoring and refinement; * Deliver legal counsel and expertise on the development of new products and services, consumer finance laws and regulations, marketing, account servicing and other business matters; * Escalate issues, as appropriate, within legal team and partner collaboratively to identify issues and share potential concerns and ideas with team members; * Work closely with issuing bank partners on marketing review, partner contracts and new product launches; * Manage the successful delivery of services by outside counsel; and * Drive and execute special projects in support of key objectives of the Legal and Compliance teams. About You * J.D. with terrific academic credentials; * State bar member in good standing; * You have at least 5 years of combined law firm or government and in-house legal department experience, demonstrating increasing levels of responsibility; * You have expertise in product counseling in consumer finance space (knowledge of TILA/Regulation Z, ECOA/Regulation B, FCRA, FDCPA a plus); * A business and solution-oriented approach to resolving issues; * Excellent interpersonal, communication, analytical and influencing skills; * Proven ability to develop collaborative relationships with internal partners and external customers, with comfort interacting with associates across departments and job levels; * You have the ability and desire to develop expertise in new or unfamiliar areas of law; * Desire to pitch in and to learn new areas of the business and legal practice; and * Propensity to thrive in a dynamic environment and successfully handle competing deadlines with minimal supervision; * Comfort in a fast-paced, creative, disruptive, test and learn culture; and * Impeccable integrity.
