Your Mission:

Medidata is seeking a Data Privacy Counsel to join our legal department's privacy team located at corporate headquarters in Tribeca, reporting directly to Medidata's Chief Privacy Counsel (SVP, DGC). Our privacy team works at the intersection of rapid developments in life sciences, cloud technology and evolving data privacy laws to help our mission of powering smarter treatments and healthier people.

The Data Privacy Counsel will provide advice on current and emerging privacy laws to support and enhance our industry-leading global privacy and data protection programs. This role works collaboratively with groups across Medidata, especially our Security, Compliance, Transactions and Product groups, and has responsibility for negotiating privacy terms and supporting customer-facing privacy inquiries.

  • Provide strategic, informed legal advice on data privacy requirements applicable to clinical trials and cloud technology, including data analytics and digital transformation

  • Implement and enhance our data privacy policies, procedures and controls, and related training and guidelines for monitoring internal compliance

  • Commercial support. Draft and negotiate privacy terms; respond to customer privacy questions in bid proposals and assessments

  • GDPR support. Support our data processor obligations by attending product development sessions (privacy by design, records of processing) and assessing subprocessors; support our data controller obligations by working with HR, Sales and Marketing to conduct data privacy threshold and impact assessments and implement related controls

  • HIPAA support. Support our commercial imaging (medical device) business, including handling customer requests related to applicability of HIPAA

  • Data governance. Assist in managing our data governance program for new and existing products and business processes; assist in ensuring compliance with third party data use agreements (DUAs, BAAs, etc.)

Your Competencies:

  • Knowledge of, and practical experience in, EU (GDPR) and US (HIPAA, CCPA) privacy laws applicable to life sciences, including transactional experience (drafting and negotiation) and experience in implementing related privacy programs. A focus on clinical research, healthcare data, data analytics and/or SaaS technology is strongly preferred

  • Experience with implementing controls that ensure privacy protection for the use, collection and disclosure of personal data, such as privacy-by-design, data flow maps, privacy impact assessments, and/or vendor management, from a processor and/or controller perspective

  • Proven work ethic and ability to independently manage multiple projects under tight deadlines

  • High level of professionalism, excellent communication skills and outstanding business judgment; ability to influence cross-functional stakeholders across a fast-growing, global organization

  • Ability to travel (up to 20%)

  • Prior experience with data privacy and data security requirements for SaaS technology

  • Prior experience with developing, assessing or maintaining formal privacy or security controls (SOC, ISO, HITECH, etc.)

  • Excellent academic credentials

  • Experience working at a software or technology company, and/or in the pharmaceutical or healthcare industry

  • CIPP/E, CIPP/US or similar privacy credentials

Your Education & Experience:

  • Juris Doctorate

  • 3+ years legal experience, including substantial global privacy or data protection experience, preferably from within a major international law firm or multinational corporation

  • Proven experience leading or implementing privacy initiatives, including demonstrated track record of implementing policies and procedures, and in designing and implementing effective training programs

THE ROLE: Privacy Counsel A+E Networks has an open position in New York for a privacy attorney in a dual compliance and transactional role, providing guidance and support on data privacy and security matters across all A+E business divisions, including Technology, Engineering, Operations, Digital, Distribution, Research, Advertising, Marketing, HR, and Finance. MORE ABOUT WHAT YOU'LL DO: * Oversee data privacy and security compliance, best practices, and risk management, to align the networks' internal procedures and external vendor and client relationships with shifting legal privacy frameworks (e.g., GDPR, CCPA, COPPA, and VPPA) and defend against evolving security threats, while facilitating the implementation of global initiatives, such as cloud migration and digital distribution. * Draft and negotiate data privacy and security provisions in a wide variety of vendor and client agreements, with an emphasis on technology transactions (e.g., SaaS/cloud contracts, and MSAs and SOWs for all manner of managed and professional services). * Work with stakeholders across the company to conduct pre-contract/pre-launch vendor and application privacy reviews, including administering privacy questionnaires and conducting privacy impact assessments. * Develop and implement internal standards and procedures for the classification, management, and protection of personal data. * Draft and update external online/mobile privacy policies, notices, and consents. * Advise on, and oversee, the creation and operation of workflows to address data subject rights requests (e.g., access, correction, deletion). * Manage the investigation and remediation of privacy complaints and data incidents, including by liaising with data protection authorities. * Create and deliver effective training, and enhance awareness, around data privacy and protection, organization-wide. YOUR STORY: * JD from an accredited law school, and member in good standing of New York State Bar. * Minimum 5 years of legal experience, with preference given to prior experience in the entertainment and/or technology fields. * Extensive knowledge of domestic and international data privacy and security legal frameworks. * Exceptional ability to draft clear, precise transactional agreement and compliance policy language, without over-relying on pre-existing templates. * Strong interpersonal, negotiation, and communication skills. * Organized, detail-oriented, and self-motivated team player, able to handle a high volume of work in a fast-paced environment, to take initiative and make decisions, and to be strategic and offer creative solutions.
