Medidata is seeking a Data Privacy Counsel to join our legal department's privacy team located at corporate headquarters in Tribeca, reporting directly to Medidata's Chief Privacy Counsel (SVP, DGC). Our privacy team works at the intersection of rapid developments in life sciences, cloud technology and evolving data privacy laws to help our mission of powering smarter treatments and healthier people.
The Data Privacy Counsel will provide advice on current and emerging privacy laws to support and enhance our industry-leading global privacy and data protection programs. This role works collaboratively with groups across Medidata, especially our Security, Compliance, Transactions and Product groups, and has responsibility for negotiating privacy terms and supporting customer-facing privacy inquiries.
Provide strategic, informed legal advice on data privacy requirements applicable to clinical trials and cloud technology, including data analytics and digital transformation
Implement and enhance our data privacy policies, procedures and controls, and related training and guidelines for monitoring internal compliance
Commercial support. Draft and negotiate privacy terms; respond to customer privacy questions in bid proposals and assessments
GDPR support. Support our data processor obligations by attending product development sessions (privacy by design, records of processing) and assessing subprocessors; support our data controller obligations by working with HR, Sales and Marketing to conduct data privacy threshold and impact assessments and implement related controls
HIPAA support. Support our commercial imaging (medical device) business, including handling customer requests related to applicability of HIPAA
Data governance. Assist in managing our data governance program for new and existing products and business processes; assist in ensuring compliance with third party data use agreements (DUAs, BAAs, etc.)
Knowledge of, and practical experience in, EU (GDPR) and US (HIPAA, CCPA) privacy laws applicable to life sciences, including transactional experience (drafting and negotiation) and experience in implementing related privacy programs. A focus on clinical research, healthcare data, data analytics and/or SaaS technology is strongly preferred
Experience with implementing controls that ensure privacy protection for the use, collection and disclosure of personal data, such as privacy-by-design, data flow maps, privacy impact assessments, and/or vendor management, from a processor and/or controller perspective
Proven work ethic and ability to independently manage multiple projects under tight deadlines
High level of professionalism, excellent communication skills and outstanding business judgment; ability to influence cross-functional stakeholders across a fast-growing, global organization
Ability to travel (up to 20%)
Prior experience with data privacy and data security requirements for SaaS technology
Prior experience with developing, assessing or maintaining formal privacy or security controls (SOC, ISO, HITECH, etc.)
Excellent academic credentials
Experience working at a software or technology company, and/or in the pharmaceutical or healthcare industry
CIPP/E, CIPP/US or similar privacy credentials
Your Education & Experience:
3+ years legal experience, including substantial global privacy or data protection experience, preferably from within a major international law firm or multinational corporation
Proven experience leading or implementing privacy initiatives, including demonstrated track record of implementing policies and procedures, and in designing and implementing effective training programs
