Company: American Residential Services


Provides legal assistance to attorneys representing the Company by conducting legal research, analyzing law sources and providing legal support in collection matters, violations of non-compete/solicitation agreements, bankruptcy issues and litigation.


  • Provides legal support and assistance to service centers and attorneys for the company on matters such as customer complaints, payroll fraud, employee fraud, garnishment issues, intellectual property, trade name violations, discovery responses, litigation, and subpoena responses.

  • Interviews service center employees/management when new cases are filed or are to be filed to provide a summary to the attorneys for the company for use in litigation.

  • Reviews and prepares written summaries of regulations or legislative bills.

  • Drafts cease and desist letters to former employees who are in violation of non-compete/non-solicitation agreements. Works with the service centers to obtain solutions to these problems by contacting in-house counsel for additional assistance or directing them to outside counsel for possible litigation.

  • Works closely with national Attorney General Offices and ARS service centers to obtain solutions regarding customer complaints.

  • Assists attorneys with complex legal research.

Job Requirements


An Associate's degree in Paralegal studies is required with paralegal certificate/licensure. A Bachelor's degree and 4-6 years of related corporate paralegal experience are desired. Related experience and/or advanced training or any equivalent combination of education and experience may be substituted. Must be computer literate with knowledge of Microsoft Office products and litigation database programs.

Essential Job FunctionsAssists lawyers in preparing for and scheduling depositions, mediations, expert witnesses, hearings, meetings, trials, conferences and court reporters. Assists lawyers in routine discovery matters, such as preparing preliminary discovery requests and responses and organizing documents in response to a request for document production. Drafts preliminary legal documents, such as pleadings, motions, affidavits, subpoenas, scheduling orders, and deposition notices. Performs legal research and write memoranda as assigned. Organizes and tracks files for important transactions or case documents, including pleadings and voluminous discovery documents, and creates and maintains a case-management database. Maintains lawyers' calendars, schedules lawyer time and completes billing sheets. Provides general clerical and secretarial support for programs and projects led by the Office of the General Counsel. Prepares basic and complex correspondence, order supplies and cover telephones for the Office of the General Counsel. Prepares and maintains a variety of reports detailing the administrative information handled by the General Counsel, records, exhibits, charts, correspondence, and files related to the Office of General Counsel. Performs other related duties as assigned or directed.Minimum Qualifications Bachelor's Degree in Business Administration, Public Administration, or equivalent experience in a legal environment, for a total education/experience of 4 years. (PROOF OF EDUCATION, TRAINING, AND/OR EXPERIENCE IS REQUIRED). Paralegal certification and five (5) years of experience preferred. Degree Equivalency Formula: Bachelor's Degree= 4 years plus required years of experience. Master's Degree= 2 years plus required years of experience. Where Master's degrees are required, years for Bachelor's Degrees must be included. Knowledge, Skills, and Abilities * Basic- to intermediate-level knowledge of court forms and filing deadlines and procedures, and demonstrated proficiency in the use of the federal PACER system and state electronic filing systems * Basic- to intermediate-level knowledge of state and federal rules of civil procedure and local rules * Basic- to intermediate-level knowledge of legal research techniques and demonstrated proficiency in the use of Westlaw and other legal document management systems * Basic- to intermediate-level knowledge of statutory principles of contract law, employment law, tort law (including the Governmental Tort Liability Act), and federal Family Educational Rights and Privacy Act * Basic- to intermediate-level knowledge of the functions of a legal department and its operating procedures * Knowledge of administrative and clerical procedures and systems such as word processing, managing files and records, stenography and transcription, designing forms, creating spreadsheets and charts, and other office procedures and terminology * Must possess strong analytical and organizational skills, good judgment, and an advanced level of initiative * Considerable ability to evaluate information, perform analysis and prepare written and oral recommendations * Ability to develop and maintain effective and positive working relationships within and outside of the legal department * Ability to balance and complete multiple and competing priorities and projects * Ability to operate a computer and use appropriate software applications and peripheral office equipment * Ability to apply general court rules to specific problems to produce answers that make sense. * Demonstrated proficiency in business English, grammar, spelling, and punctuation Physical Requirements and Working Environment Physical Demands: Requires sedentary work involving standing or walking for brief periods, exerting up to 10 pounds of force on a regular basis; and some dexterity in operating office equipment; must be able to use hands and fingers for sign language.
