Open source has become core to Microsoft's culture and business, and Microsoft has become one of the industry leaders in open source participation, active open source projects, and usage. As an attorney on Microsoft's Open Source and Standards Legal Team, you'll play a vital role in helping Microsoft navigate and succeed in this open environment, and also provide frontline product counseling support for Developer Tools and Services in Microsoft's Cloud + AI division.

An attorney with open source experience is highly desired with:

  • An interest or working knowledge of copyright, software licensing, patents, and non-profit corporate governance.

  • Experience in product development legal support and technology transactions.

  • Legal experience as a practicing attorney.

  • Strong negotiation and diplomatic skills.

  • Ability to collaborate effectively across diverse groups and communities.

  • Excellent communication and drafting skills.

  • Strong judgment and the ability effectively balance legal risks against business interests.

  • A bias for action and driving client-focused results.

  • A J.D. or a license to practice law in the U.S.

  • Flexibility in adjusting to workload fluctuations and business imperatives.

The main responsibilities for this multidisciplinary role include:

  • Counseling clients and providing subject matter expertise on open source.

  • Advising and coaching clients on open source licensing, compliance, strategy, engagement approaches, and the company's open source policies and best practices.

  • Representing Microsoft in open source foundations, committees, and communities.

  • Working with engineering groups to help Microsoft engage in open source at scale.

  • Providing frontline legal and business counseling to engineering and program manager clients in the Developer Tools and Services business, including analyzing legal, business, and engineering issues; working with the clients and others in the legal department to design creative solutions; and drafting and negotiating a variety of contracts and other legal documents.

  • Collaborating with experts across the company on issues such as patents, copyright, privacy, antitrust, and corporate law.

The position is based in Redmond, Washington. The commercial business for Microsoft 365 is one of the most impactful business for the company, comprised of Office 365, Windows, and Enterprise Management Security. The role will include a broad and varied portfolio of legal work including counselling and legal support for the commercial business of the Microsoft 365 Marketing team. Desired qualifications: * Excellent academic credentials, a J.D. or equivalent from an ABA accredited law school or equivalent non-U.S. law degree, and an active license to practice law. * Experience in counseling complex and broad legal issues and in the software industry is preferred. * 10+ years as a practicing attorney, preferably with both law firm and in-house experience. * Sound judgment that incorporates strong legal analysis, a pragmatic approach, and consideration of business goals, risk tolerance, and stakeholder priorities. Desired skills and attributes: * Excellent writing and communication skills including the ability to communicate complicated legal and policy advice clearly and succinctly to a variety of different audiences from a diverse set of disciplines (lawyers, project managers, engineers, business executives) and cultures. * The ability to work collaboratively, negotiate, and generate consensus among those with diverse points of view. * Comfortable with ambiguity and a bias for action in a fast-paced, matrixed environment. * Project management skills and the ability to work efficiently and meet deadlines in the face of competing priorities. * A desire to grow and take on new challenges as they arise. * Ability and willingness to adapt quickly as the legal, policy and factual landscape continues to evolve.
