Job Summary

The Legal Services Director

  • Contract Management is responsible for the management of the Company's contract management function, including the development, documentation and implementation of appropriate processes and procedures, documents, and the supervision of the contract management team and associated performance metrics associated with the contract management function. Responds to day-to-day legal/compliance/risk management services needs relating to contract management in accordance with established policies, procedures, and processes.

The Director exercises independent decision making with respect to matters within scope of expertise. Exercises sound judgment to identify and seek decision support on matters outside core subject matters expertise. Manages, assures quality, and continuously improves legal and/or processes and projects relating to contract management activities of the Company's facilities. Interacts with outside counsel as well as Company employees on a regular basis. Works collaboratively with team members to coordinate legal services, manage administrative functions of the Company's contract management function and any associated software management system(s).

Essential Functions

  • Establishes and implements consistent processes and procedures across the organization with respect to the management of matters related to referral source agreements and other agreements that require pre-approval.

  • Supports ScionHealth facilities and corporate departments on matters related to referral source agreements and other agreements that require pre-approval. Tracks, routes, and archives agreement that have completed the review process with the designated attorney, follow up with approvers to ensure agreements are timely approved.

  • Implements and maintains process for creation and regular updating of consolidated contract templates for use across the organization.

  • Develops and implements system for tracking and reporting potential policy deviations related to contracting, reportable events and applicable Stark exceptions to ensure that regulatory limitations on the use of a given exception is not exceeded.

  • Monitors trends in the operational aspects of ScionHealth to develop processes, templates, and training, utilizing available technologies to improve and promote efficiency, consistency, and compliance with regulatory and business requirements.

  • Monitors changes in federal and state laws and regulations that may impact contracting processes and requirements, requiring changes to templates or other documents.

  • Participate in and help lead regular calls and meetings related to the establishment of an organization-wide Contract Management Council and other Company projects relating to contract management.

  • Oversees the management of MediTract, the Company's chosen contact management tool.

  • Triage and respond to requests for assistance in appropriate priority and communicates plans for addressing needs to supervisor.

  • Participate, as needed, in asset acquisitions and divestitures, including assisting with on-boarding of new acquisitions and compiling due diligence materials for divestitures.

  • Supervises contract management team members effectively.

  • Regularly leads and/or contributes significantly to one or team projects as assigned.

Knowledge/Skills/Abilities

  • In-depth understanding of healthcare regulatory and compliance statutes (e.g., Physician Self-Referral and Kickback laws, HIPAA).

  • Knowledge of federal and state laws and regulations pertaining to the operation of healthcare facilities.

  • Effectively communicates information to business line leaders, facility leadership and other employees.

  • Ability to handle multiple projects simultaneously including task delegation, project oversight, and resource allocation.

  • Ability to communicate complex information and present, resolve, and address delicate situations.

  • Ability to solve complex, ill-defined, and varied business problems, requiring analysis or interpretation of the situation, with decision support. Problems are solved using knowledge and skills, general precedent, and practices.

  • Excellent computer skills including knowledge of Windows, Microsoft Office, Adobe.

  • Ability to work with individuals at all levels of the organization.

  • Excellent verbal and written communication skills.

  • Exercises discretion with confidential and sensitive information.

  • Skilled at working independently and as part of a team.

  • Approximate percentage of time required to travel: 5%.

Education

  • Bachelor's degree in related field or paralegal degree from an accredited school.

Experience

  • 10 years' experience in a law firm or corporate legal setting or related field.

Depending on a candidate's qualifications, this role may be filled at a different level.
