What you'll do

Overview

Partners with the Associate General Counsel Global Litigation & Employment to provide legal advice and counsel on litigation related matters, including supporting the AGC on key litigation matters and independently managing other litigation and threats of litigation. Works directly with business partners, operates independently on matters within his/her purview, and executes against goals and objectives set by the AGC and/or Wendy's, with a primary focus on minimizing or eliminating legal and economic risks.

Specific Responsibilities Include

  • Serves as primary legal counsel overseeing commercial disputes and litigation, managing assigned matters from inception to conclusion, including budget management, outside counsel management, and management of internal processes such as legal holds, witness interviews, and document collection. Assist AGC with management of other key litigation matters and initiatives as needed.

  • Manage and oversee litigation related processes and procedures to ensure consistent processes and protection of Company, including on matters being handled by franchisees' counsel.

  • Manage Company's response to third-party subpoenas for business records, court appearances, and other third-party litigation matters. Advise other business units on litigation and dispute matters, including Risk, Payroll, and HR.

  • Supporting AGC or General Counsel on an "as requested" basis on special projects.

What we expect from you

Education / Experience

  • Masters Degree; additional education information (major, etc.): J.D.

  • Law firm and/or in-house attorney experience: 2-4 years

  • Flexible attorney with focused experience in commercial litigation and excellent soft skills, Including a demonstrated a willingness to learn, enthusiasm for being a part of the Company's in-house legal department, and a hard-working and ethical legal partner with a customer service mindset

General Summary: This position is responsible for conducting joint field work with the District General Agents (DGA), Agency Development Managers (ADM), and Sales Representatives (60-70%). Additionally, the Sales Trainer is responsible for delivering classroom training to new sales representatives on opening and enrolling skills within the territories they support (10-15%). Principal Duties and Responsibilities * Within the framework of our District Fast Start program, effectively deliver Direct Sales training to new managers in a manner that is completely consistent with the standard Colonial Life College curriculum. This includes effective delivery of both classroom facilitation and joint field work. * Effectively drive ADM development. This would include, but is not limited to: delivery of ADM training sessions, leading ADM Builder's Council meetings and initiatives, providing mentorship for ADMs, and driving territory specific ADM communication programs. * Assume ownership for prospecting activity within the territory to include: leading prospecting sessions that support the "Hard Calendar" system, drive participation in regularly calendared prospecting activities across the territory through effective communication and promotion campaigns, and be an active participant in these sessions. * Effectively deliver classroom instruction for new sales representatives and new sales managers on basic to intermediate opening and enrolling consistent with the standard Colonial Life College content. * Conduct productive and quantifiable joint field work with new sales managers utilizing our standard processes for prospecting and decision maker presentations. * Accurately and consistently provide required joint field work reports as directed. * Execute pre and post class follow-up with attendees to ensure preparedness and report in on sustained sales activities post class. * Complete all required administrative paperwork and deliver to the appropriate party. * May perform other duties assigned. Job Specifications Required: * Prior experience in education, training and development. * Prior experience in sales within the insurance industry - specifically in the Voluntary Benefits industry. * Demonstrated ability to drive and lead company programs/initiatives. * Previous management experience or demonstrated ability to mentor and develop Sales Managers * Proficiency in coaching and facilitator skills. * Strong organization skills with results orientation. * Ability and willingness to travel 80% of the time regionally. * Strong interpersonal skills. * Strong work ethic and ability to work effectively with little direct supervision. * Solid presentation and written/verbal communication skills. Preferred: * College degree or equivalent experience. * Highly proficient in prospecting and selling skills * Highly organized and attention to details. * Working knowledge of personal computers, Microsoft Office software and Internet.
