POSITION SUMMARY:

This position will be responsible for (i) identifying risks, developing business-focused solutions, and managing legal exposure, (ii) ensuring compliance with Company policies, and (iii) promoting best practices with regard to risk management and fiscal responsibility in all areas of employment law, including direct-store-delivery and distribution models. This role reports to the Managing Counsel, Employment Law, but will also take direction from the Division General Counsel for Sales, the SVP and General Counsel, and Business and HR Leadership teams.

The Legal Counsel, Employment Law will work closely and collaboratively as part of the Employment Law Team, as well as with their legal colleagues at the Company, other Nestl affiliates in the U.S. market, and Human Resource teams to provide counseling, advice and solutions on all areas of employment law at every step in the employee life cycle. Strong focus on and support of Nestl's Direct Store Delivery system and other Go-to-Market strategies. This role works with Human Resources and business leaders to identify and manage business risk through providing practical solutions. This position will also review, edit and streamline policies and procedures in an effort to ensure policies are both practical and enforceable. The ideal candidate will build strong relationships with every member of the organization and can effectively collaborate with key stakeholders in order to solve intricate problems.

This position is also responsible for overseeing sensitive internal investigations, audits, complaints, EEOC, DOL and other administrative charges as well as pre-litigation claims and litigation subject matter expertise. This position also provides periodic legal training and legal updates. Regular business travel is required.

PRIMARY RESPONSIBILITIES:

  • Provide legal support for varying Direct Store Delivery ("DSD") efficiency projects, as well as provide advice on varying compensation structures for hourly & commissioned employees.

  • Support internal restructure and/or reorganizations as the DSD business continues to grow.

  • Day-to-day employment law counseling and advice for Nestl and affiliated companies.

  • Identify risks and trends, and develop proactive strategies and solutions for HR.

  • Enable and remove obstacles to support HR and business partners frontline focus to ensure Nestl wins in the marketplace.

  • Manage docket of administrative charges, pre-litigation claims, investigations and audits.

  • Provide subject matter expertise in support of litigation counsel with respect to employment-related litigation as needed.

  • Provide training and other updates to stakeholders and ongoing training on pertinent topics, including changes to employment laws, risk assessments, legal trends, and compliance.

  • Other duties, tasks, special projects, and responsibilities as assigned.

SUPERVISION RECEIVED:

Position operates under minimal supervision.

SUPERVISION GIVEN:

In addition to routine client counseling, may provide guidance and direction to support staff.

REQUIREMENTS AND MINIMUM EDUCATION LEVEL:

  • JD from accredited law school required.

  • Current membership in good standing in the Virginia State Bar or the ability to become Registered In House Counsel in Virginia.

  • Minimum of 4-6 years of experience as an employment lawyer, in-house counsel experience preferred.

  • Experience with litigating and counseling on employment matters in the areas of discrimination, disability accommodation, hiring, performance management and discharge, whistle blower, wage and hour, Department of Transportation compliance, organizational re-design and other labor and employment issues.

  • Experience drafting and/or advising on sales incentive programs and varying compensation structures.

  • Experience drafting employment-related contracts, executive summaries, forms, memoranda and pleadings, persuasive arguments, clear summaries of legal and regulatory requirements

  • Ability to concisely interpret compliance requirements into action plans for Human Resources and provide support to implementation.

  • Experience investigating and/or advising investigations of employment-related matters.

  • Excellent communicator with the ability to engage with and influence stakeholders across the company and at all levels of the organization.

  • Self-starter with willingness to take on special projects.

  • Background representing large, complex businesses and working with all levels of leadership.

PREFERRED EXPERIENCE:

  • At least 2-3 years of prior in-house experience supporting DSD model and/or distribution network, as well as Account Selling teams.

  • Prior in-house experience with a large, matrixed organization

  • Experience with food, beverage or other consumer products industry is a plus;

  • ERISA experience a plus

POSITION SUMMARY: The Paralegal, Employment Law provides support for the employment law team of the Nestle USA legal department. This role will help assist with day-to-day employment matters, the administrative charge process, and litigation efforts. The detail-oriented person filling this position will be adept at maneuvering through large, multi-functional and complex organizations and will demonstrate the ability to foster a positive working relationship with their peers, corporate attorneys, outside counsel and Nestlé client base. PRIMARY RESPONSIBILITIES: * Provide routine paralegal support to Company attorneys involved in labor and employment-related legal matters. * Respond to routine legal inquiries and draft routine correspondence. * Assist in payment and tracking of vendor invoices in legal billing system. * Assist in electronic discovery process by creating and distributing legal holds, tracking legal holds and custodians as they change positions or leave the Company, assessing when holds can be lifted, in consultation with attorney supervisors, and communicating with hold recipients regarding status. * Assist employment attorney(s) with monitoring and reporting recent employment law trends to department and management. Provide regular updates on employment trends and changes in legislation. * Track and regularly report out to employment law team on status of administrative charge docket. * Coordinate with in-house Litigation team as needed on all employment-related litigation matters. * On cases for which outside counsel is assigned, serve as initial contact with clients on administrative matters to gather documents and information necessary to prepare written responses to administrative charges. Summarize information gathered for inside and outside counsel, if any, and work with HR to follow up on any additional information needed. Assist outside counsel with scheduling interviews and depositions as necessary. * With supervision of assigned, in-house employment attorney, conduct case-relevant investigations and prepare position statements and exhibits in response to administrative charges. * Conduct necessary legal and/or business research and provide timely, clearly written and relevant information in response to legal inquiries. * Draft form documents and templates, make recommendations regarding standardized and best practices to facilitate processes, procedures and policies. * Assist with implementation of new policies and/or procedures. * Oversee and manage research projects by outside firms to completion. * Other duties as assigned, such as assisting supervising attorneys with workflow submitted for review by clients; maintaining content on employment law share drive and generating and distributing reports as requested REQUIREMENTS AND MINIMUM EDUCATION LEVEL: * Undergraduate degree preferred. * National accreditation as a Certified Paralegal strongly preferred. * Notary license a plus. EXPERIENCE: * 5-7 years relevant experience in a corporate legal department/law firm. * General knowledge of the administrative and litigation process Experience interviewing witnesses, preparing exhibits, and reviewing, drafting and writing position statements. * Previous experience with employment law a plus. * Experience in the consumer packaged goods industry a plus.
