About the Position

The Probation Department is seeking a Legal ClerkI, II, or III (based on experience and qualifications).Under general supervision Legal Clerks may perform specialized clerical work of a legal nature where the majority of tasks are completed for attorneys, the courts or the criminal justice system demonstrating proficiency on a wide variety of office equipment; may act as a lead worker and assist in the training of other staff; and does other related work as required.

Typical Tasks and Representative Duties

(Not in order of importance)

  • Transcribes dictation involving legal terminology from civil or criminal legal forms.

  • Prepares various legal documents and forms, such as complaints, briefs, motions, agreements, resolutions, ordinances, opinions, subpoenas, contracts, extradition forms, information, indictments, jury instructions, and verdicts.

  • Prepares correspondence for use in court, legal proceedings, or for other legal matters.

  • Gathers information and compiles reports.

  • Reviews and finalizes legal pleadings, correspondence, or other documents for filing or transmission to others.

  • Provides information to other staff and partner agencies regarding legal mandates, regulations, and department policies and procedures.

  • Maintains office calendars reflecting court dates, public, agency, and office meetings, and court or agency filings; may file extensions for documents due to the court.

  • Files legal documents with the County Clerk, with the courts, or other agencies.

  • Ensures timely processing and completion of documents in compliance with court rules and procedures.

  • Verifies accuracy of citations by comparing with legal reference materials.

  • Obtains and verifies information maintaining confidentiality regarding attorney/client communications.

  • Assists the public by answering questions and explaining procedures.

  • May receive and process payments and prepare receipts for payment of fees.

  • Gathers files and other information based on court calendars.

  • Liaises with department attorneys or legal staff, County Counsel attorneys, or third-party attorneys.

  • Creates and maintains case files, and other files of a legal nature.

  • Keeps abreast of legislation affecting legal procedures and county and special districts' organization.

  • Operates a variety of office equipment.

  • Uses computers and related technology efficiently.

  • Performs other related duties as assigned.

This recruitment may be used to fill future permanent, substitute, limited term, and temporary positions, both full-time and part-time throughout the County.

The Ideal Candidate

The ideal candidate will have an interest in the legal system, have a strong attention to detail and work well under pressure. The Probation Department is seeking an individual who has great communication skills both orally and in writing, can work independently, and can work in an environment where priorities are constantly changing.

Education and Experience

A combination of education, training, and experience resulting in the required knowledge, skills, and abilities. An example of qualifying education and experience includes:

Legal Clerk I: One year of clerical experience in a legal office, court, or criminal justice system;

Or one year of experience equivalent to an Administrative Assistant II.

Legal Clerk II:Two years of experience performing increasingly complex legal, court, or legal document preparation work;

Or one year of experience equivalent to a Legal Clerk I or Administrative Assistant III.

Legal Clerk III: Three years of experience performing increasingly complex legal, court, or legal document preparation work;

Or one year of experience equivalent to a Legal Clerk II.

Background Check

To accept a position with the Probation Office, you must successfully complete a Background Investigation. Below is a partial list of offenses or issues that may disqualify you from successful completion. Please review the below list:

  • Any felony conviction

  • Recent misdemeanor conviction, or any two misdemeanor convictions as an adult

  • Poor employment history

  • Any sale, manufacture, or cultivation of illegal drugs

  • Recent use of illegal substances such as opiates, hallucinogens, injectables, cocaine, methamphetamine, or similar substance

  • Poor driving record such as numerous hazardous traffic violations or chargeable accidents

  • Recent conviction for driving under the influence of alcohol and/or drugs, or any two convictions for this offense as an adult

  • Any act of domestic violence, as defined by law

  • Any crime committed against a child

  • Behavior or derogatory remarks constituting discrimination or bias toward others based on their race, religion, gender, national origin, ethnicity, sexual orientation, or other protected class

  • Any material misstatement of fact or intentional omission of information during the application or background process

Issues that arise during the investigation process will be assessed, and judgement and discretion will be used to determine the employability of the candidate. Where there is evidence of a candidate's past use of controlled substances, many factors shall be used to determine the employability of the individual such as a pattern of use, kind of drug used, circumstances of the start of the drug use, treatment, behavior, and attitude since discontinuance, etc. Please note that a history of using controlled substances does not result in automatic disqualification from the selection process. Prior to disqualifying any candidate whose profile falls within the provisions of the policy, the candidate shall be given the opportunity to present any and all evidence of mitigating facts that the candidate feels should be considered by the hiring authority.

The results of the background investigation shall be confidential and shall not be available to the candidate or any unauthorized individuals for review.
