Job Overview

Primary Purpose and Essential Functions: To provide litigation support for Claims Department.

  • Work with adjusters, defense counsel, and other terminal personnel to place Swift equipment on Claims Litigation Hold. Maintain and perform follow up communications regarding equipment hold log as necessary or required.

  • Gather time-sensitive data for serious accidents.

  • Schedule and coordinate corporate representative and current employees for depositions and trial appearances.

  • Monitor discovery deadlines to ensure timely responses.

  • Maintain Discovery Log, which lists outstanding discovery requests and pertinent information regarding the various requests including dash cam video footage.

  • Maintain Swift Approved Defense Counsel Directory of counsel approved to handle Swift litigation matters.

  • Create and maintain legal files and docket.

  • May prepare written reports to defense counsel regarding discoverable Swift material; organize and pattern discovery documents and responses in appropriate file format to make them available and easily accessible to Company personnel and outside counsel. Monitor discovery deadlines.

  • May review legal invoices submitted by defense counsel for reasonableness and accuracy and direct the process for payment.

  • May prepare and draft Swift responses to pretrial discovery; coordinate with and gather information from adjuster and defense counsel; investigate claim facts; identify and gather Swift documents relative to the discovery request as necessary or appropriate for supervisor's review.

  • May draft and prepare referral correspondence to defense counsel with respect to preservation requests and lawsuits.

  • Perform additional duties as directed by attorneys and adjusters.

  • Skills:
    Must be able to meet deadlines. Must possess good understanding of legal terminology. Must be able to research and investigate as needed. Must be able to multi-task and solve problems. Must be able to work well with others. Must possess a high level of professionalism and interact with various members of the company and outside counsel.

  • Education: High School diploma or GED required. Associates' or paralegal certification preferred.

  • Experience Required: Two years' litigation experience in a law firm or legal department for a corporation required.; computer systems and software. Previous experience with MS Office required. Exceptionally accurate and fast typing skills required.

The Role Under general supervision, conducts the review and investigation, liability determination, and management of disability claims. Depending on assignment, may manage either more complex short-term disability only claims or long-term disability only claims. Applies the appropriate contractual provisions; legal guidelines; case management resources; and claim procedures, concepts, principles, and protocols to risk manage claims. Regularly exercises independent judgement in interpreting information. Uses disability claim system to manage and pay claims while meeting all service, timeframe, and productions standards. Forwards claims on to more senior Case Managers if the complexity of the claims exceed the complexity responsibility and authority guidelines. Functional Responsibilities Consultation and Analysis * Conducts investigations to determine whether or not to accept liability and to what degree. Approves or denies benefits accordingly. * Calculates the liability for each claim applying all appropriate offsets such as social security, workers compensation and third parties. * Continually assesses claim details to determine if claims are going to exceed case management authority guidelines. * Evaluates and refers appropriate claims to risk management resources such as Vocational Rehabilitation, Managed Care, Fraud, Social Security, and Subrogation. * Manages claims within multiple funding arrangements. * Updates and accurately documents system and claim files on actions taken. Establishes future action plan and case direction. Communication * Communicates with claimants, employers, and various medical professionals to gather information regarding the application for, payment of, and ongoing management of STD or LTD benefits. * Responds to various written and telephone inquiries including eligibility, approval/denial determinations, status and continuation or closure of benefits. * Identifies, calculates, communicates, and follows-up on overpayments. * Maintains the established customer service, production, and quality standards. * May be assigned to provide guidance and assistance to others. Requirements Education * High School Diploma or equivalent work experience (4 yrs of experience in lieu of Bachelors) Experience * Communication, organizational, problem solving, and computer skills required. * Excellent writing, customer service, and interpersonal skills necessary. * Knowledge of insurance, medical terminology, and case management in same or similar discipline a preferred. * A demonstrated track record of consistently meeting and/or exceeding performance expectations * Possesses a bias for action and avoids workplace distractions * Drives performance targets to completion #LI-JD1 This position may be subject to Lincoln's Political Contribution Policy.
