The Job

The Intellectual Property Counsel is responsible for development and implementation of part of LivaNova's global intellectual property (IP) strategy focusing on value creation for a business unit and overall business, including counseling LivaNova management, business unit R&D and Marketing teams, and colleagues on potential legal and financial implications of corporate and business activities, and the effective management of services provided by outside counsel. The individual reports to the Chief Intellectual Property Counsel.

Key Responsibilities

  • Develop and maintain technical expertise on LivaNova's existing, planned, and future products, as well as related anatomy and physiology by regular, ongoing consultation with LivaNova engineering, clinical, regulatory and manufacturing employees.

  • Develop detailed expertise in the scope of LivaNova's intellectual property portfolio and coordinate and alignment with global strategy.

  • Review and negotiate contractual agreements, including IP licenses, collaboration, Material Transfer Agreements, Non-Disclosure Agreements, and provide advice and support on IP provisions on a wide range of contracts as needed.

  • Create and implement processes, guidelines, and trainings related to IP Matters

  • Provide strategic counsel regarding the competitive IP landscape for LivaNova's current product portfolio and future technology plans, protecting LivaNova's IP rights worldwide.

  • Ensure cross-collaboration with internal commercial, clinical, research and development and business development teams in implementing LivaNova's pipeline growth and long-term commercialization strategy, such that IP considerations are taken into account and potential risks are managed. Conduct, manage and counsel the business on patent and trademark clearance projects.

  • Create and implement fiscally-responsible, IP strategy for business units with consideration of resources, including developing, maintaining and optimizing a broad global IP portfolio in a cost-effective manner.

  • Manage IP-related budgets, forecasting and resources.

  • Oversee trademark opportunities and risks for LivaNova's programs and operations worldwide.

  • Provide periodic reports to direct supervisor concerning the status and direction of intellectual property, including patents and trademarks.

  • Provide IP training for LivaNova personnel to support the development and implementation of LivaNova IP strategies.

Minimum Qualifications

  • J.D. and active license to practice before the U.S. Patent and Trademark Office is required, along with a Bachelor's degree and/or advanced degree in science or engineering.

  • 6+ years' experience (device, biotechnology-preferred).

  • Experience with IP litigation/IPR process.

  • Demonstrated understanding of international legal IP landscape and laws to counsel European business locations.

  • Demonstrated business acumen with the ability to grasp important business issues and legal issues.

Pay: A reasonable estimate of the annual base salary for this position is $124,000 - $206,750 + discretionary annual bonus. Pay ranges may vary by location.
