DESCRIPTION

Department of Health and Human Resources (DHHR)/ Office of the Cabinet Secretary/ Office of the Inspector General, Kanawha Co. - Under administrative direction of the Secretary of the Department of Health and Human Resources, the Inspector General oversees the units of Investigations and Fraud Management, Medicaid Fraud Control, Board of Review, Quality Control, WV Cares, Olmstead and Office of Health Facility Licensure and Certification. Through these organizational units, the Office of the Inspector General, by impartial evaluation, investigation and reporting, ensures the integrity of the department programs and operations and promotes safe and quality healthcare facilities.

The Inspector General plans, directs and supervises the work of the units of the Office of the Inspector General; approves policies and procedures of actions of the units; represents the office at department meetings and meetings with state and federal agencies; writes or approves reports submitted to the secretary or state and federal agencies; develops and submits an annual budget and monitors monthly expenditures in the units; and maintains an effective working relationship with state and federal agencies, law enforcement officials and prosecuting attorneys. Performs other duties as assigned.

MINIMUM QUALIFICATIONS

TRAINING: Graduation from a regionally accredited or American Bar Association accredited law school.

SUBSTITUTION: Master's degree from a regionally accredited college or university in sociology, social work, criminal justice, corrections, counseling, behavioral science, industrial relations/management, public administration, business administration, or closely related field, plus two additional years of qualifying experience as described below may substitute for the JD degree.

EXPERIENCE: Six years of full-time or equivalent part-time paid administrative or professional experience in the area of assignment, four years of which must have been in a program administration capacity.

Serves as the advisor and chief legal authority receiving general policy direction from the Cabinet Secretary. Examples of Work * Advises Cabinet Secretary and department officials on complex legal issues related to DHHR programs and laws. * Drafts and reviews DHHR legislation and rules. * Responsible for providing direction to staff on administrative procedures, court procedures, and compliance. * Assists in the development of DHHR policy on various issues. * Makes recommendations concerning amendments to administrative regulations, legislation, and the appeal of contested cases. * Consults with other attorneys in the department on the interpretation of court opinions and statutes, the application of rules and regulations and related matters where complex legal issues or facts are involved. * Works closely with the Office of the Attorney General on legal matters affecting the department. * Coordinates the activities assigned to the office. * Responds to complaints and questions from the public. Knowledge, Skills and Abilities * Knowledge of the Constitution, statutes, court decisions, state and federal laws and regulations, and established department policy. * Knowledge of legal methods and processes, including the administrative regulation promulgation process, legislative drafting and the legislative process. * Ability to analyze facts and legal documents. * Ability to interpret laws, regulations and policies. * Ability to conduct administrative hearings. * Ability to effectively communicate, both orally and in writing, with persons having a wide variety of education backgrounds. * Ability to maintain effective working relationships with fellow employees, other agencies, the public, and the federal government. * Ability to speak effectively in public. Minimum Qualifications Education: Admission to practice law in the State of West Virginia. Experience: Nine years of full-time or equivalent part-time paid experience in the practice of law, including trial experience in administrative or judicial proceedings. Substitution for Experience: One year of full-time or equivalent part-time paid employment as an attorney with the agency to which assigned shall be considered the equivalent of two years of other qualifying experience. Preference will be given to individuals with experience in health care law.
