The General Counsel and Compliance Officer is responsible for assuring Southern Mono Healthcare District dba Mammoth Hospital (SMHD) at all times maintains business integrity, that all applicable statutes, regulations, and policies are followed, that behavior in the organization aligns with the Code of Conduct, and that a culture of legal and ethical compliance is promoted to help ensure the delivery of safe and reliable care to all patients. The General Counsel and Compliance Officer has the authority to review all documents and other information relevant to compliance activities, including, but not limited to, patient records, billing records, personnel records, records concerning marketing efforts and all arrangements with third parties, including without limitation employees, independent contractors, suppliers, agents and physicians. The General Counsel and Compliance Officer advises Senior Management and the Board of Directors on compliance and legal issues relevant to hospital operations as requested in a timely and effective manner. The position reports to the CEO and SMHD Governing Board, and has direct access to the Senior Management Team.

What You'll Do:

  • Maintains current licensure of all SMHD facilities and clinics through the California Department of Public Health.

  • Collaborates with other departments to direct compliance and legal issues to appropriate channels for investigation and resolution. Independently investigates and acts on matters related to compliance, including design and coordination of internal investigations and implementation of any corrective action(s).

  • Ensures effective processes are in place to confirm that employees, independent contractors, and agents of the Hospital have not been excluded from participating in Medicare, MediCal or any other federal or state health care program.

  • Serves as a member of the hospital's Patient Grievance Committee.

  • Maintains a good working relationship with leadership and staff in other key operational areas such as administration, finance, audit, coding, billing, safety, and all clinical departments.

  • Provides counsel and guidance to senior managers regarding legal considerations associated with operational issues.

  • Possesses a fundamental knowledge of major federal and state laws governing District Hospital and Rural Health Clinic operations. These include, but are not limited to, fraud and abuse laws, self-referral prohibitions, EMTALA, HIPAA, and laws relating to tax-exempt organizations. Possesses and continuously develops a fundamental knowledge of California healthcare district law.

  • Consults with external legal counsel as needed to resolve difficult or highly specialized legal issues.

  • Coordinates with CEO to ensure alignment on legal and compliance priorities.

  • Works with CEO and CEO's administrative assistant to prepare agenda and prior meeting minutes for monthly SMHD public Board meetings to ensure compliance with the Brown Act.

  • Provide advice to SMHD Board on Brown Act compliance throughout monthly and special Board meetings.

  • Ensures compliance with government entity claims presentation requirements for claims made against SMHD, as well as satisfaction of notification obligations to insurance carriers as appropriate.

  • Monitors the passing of new legislation impacting SMHD facilities, clinics, providers and employees and updates all appropriate departments/personnel regarding new laws and changes to existing laws to ensure compliance.

  • Reviews, drafts, and represents SMHD in negotiation of various transactions and vendor/service provider contracts, including contracts for architect services, construction services, financial consultants, software licenses, professional services of physicians and other practitioners, etc.

  • Prepares legal document templates to standardize contracting process.

  • Assists Privacy Officer and Security Officer with compliance with the HIPAA and the California Confidentiality of Medical Information Act, including updating internal processes as needed for compliance and providing direction on all breach response reporting and notification responsibilities.

What You'll Need:

  • Juris doctor (JD) required.

  • California Bar License required.

  • Minimum five years experience in healthcare law required. Five years of experience in healthcare compliance preferred.

Job Information:

  • Full-time, day position.

  • Annual salary range $169,020.80 to $240,718.40.
