Title: Fiduciary Litigation Session
Starting Pay: $24 an hour - up to 37.5 hours a week
Departmental Mission Statement: The Probate and Family Court Department's mission is to deliver timely justice to the public by providing equal access to a fair, equitable, and efficient forum to solve family and probate legal matters and to help and protect all individuals, families, and children impartially and respectfully. The Probate and Family Court Department has jurisdiction over family-related and probate matters, such as divorce, paternity, child support, custody, parenting time, adoption, ending parental rights, abuse prevention, wills, estates, trusts, guardianships, conservatorships, and name changes. The court has 14 divisions.

This internship offers a hybrid work structure where interns will be able to work remotely and from a Courthouse
Position Summary: The intern, under the supervision and guidance of the Administrative Office of the Probate and Family Court, will assist with analyzing and researching legal issues for the justices of the Fiduciary Litigation Session. The intern's primary duties may include, but are not limited to, the following:
Research and analyze issues of law, particularly those related to probate, estate, and trust matters
Draft research memoranda
Assist with preparing orders, judgments, and memoranda of decision
Attend court sessions
Assist with organizing case files and perform other case processing duties
The intern will be primarily located in the Norfolk Division of the Probate and Family Court but may be asked to travel to the Marlborough District Court as needed.
Duties: The Fiduciary Litigation Session is a pilot project in the Probate and Family Court. Its goal is to provide a specialized forum for the speedy resolution of complex probate litigation cases and to provide individualized and collaborative case management to reduce the costs associated with fiduciary litigation. The Fiduciary Litigation Session may accept cases that fall into the following categories: contested cases involving the probate of a will, determination of heirs, or appointment or removal of a personal representative; contested conservatorship, estate, and trust accounts; trust petitions; equity complaints involving issues related to estates and trusts; removal of conservators; and petition to partition actions. Cases are accepted based primarily on the complexity of the matter and the need for substantial case management. The Fiduciary Litigation Session accepts cases from all divisions of the Probate and Family Court and primarily hears matters at the Norfolk Division of the Probate and Family Court, and at the Marlborough District Court.

Minimum Requirements:
Enrolled in and completion of 1L or 2L year in an accredited law school
Excellent legal research and writing skills
Knowledge of Microsoft Office and other computer software
Ability to work independently and as part of a team
Ability to communicate clearly and effectively
Demonstrated interest in probate and trust law is preferred, such as completion of a trusts and estates law course, including a basic understanding of the Massachusetts Uniform Probate Code (MUPC) and/or the Massachusetts Uniform Trust Code (MUTC)
