Responsibilities

  • Serve as the Equal Employment Opportunity (EEO) Manager for Arlington National Cemetery (ANC), and is the principal advisor to the Executive Director of ANC and all levels of management in all EEO related matters.

  • Responsible for the devloplemnt, administration, and compliance of ANC's EEO Program.

  • Manage and administer the informal and formal complaints processing at Arlington National Cemetery.

  • Ensure that policies and procedures are designed to provide timely and equitable adjudication of individual and class complaints.

  • Conduct strategic planning and analysis, special projects, and all short/long-range planning for ANC's EEO Program.

  • Evalaute new and complex legislation, public laws, regulations, policies, and procedures related to EEOand their impact on ANC programs.

Specialized Experience: One year of specialized experience which includes managing an EEO program for an organization; processing informal and formal EEO complaints for an organization; ensuring an EEO program is compliant with all applicable laws and regulations; evaluating the performance of an EEO program. This definition of specialized experience is typical of work performed at the next lower grade/level position in the federal service (GS-12).

You will be evaluated on the basis of your level of competency in the following areas:

POSITION SUMMARY: This position will be responsible for (i) identifying risks, developing business-focused solutions, and managing legal exposure, (ii) ensuring compliance with Company policies, and (iii) promoting best practices with regard to risk management and fiscal responsibility in all areas of employment law, including direct-store-delivery and distribution models. This role reports to the Managing Counsel, Employment Law, but will also take direction from the Division General Counsel for Sales, the SVP and General Counsel, and Business and HR Leadership teams. The Legal Counsel, Employment Law will work closely and collaboratively as part of the Employment Law Team, as well as with their legal colleagues at the Company, other Nestlé affiliates in the U.S. market, and Human Resource teams to provide counseling, advice and solutions on all areas of employment law at every step in the employee life cycle. Strong focus on and support of Nestlé's Direct Store Delivery system and other Go-to-Market strategies. This role works with Human Resources and business leaders to identify and manage business risk through providing practical solutions. This position will also review, edit and streamline policies and procedures in an effort to ensure policies are both practical and enforceable. The ideal candidate will build strong relationships with every member of the organization and can effectively collaborate with key stakeholders in order to solve intricate problems. This position is also responsible for overseeing sensitive internal investigations, audits, complaints, EEOC, DOL and other administrative charges as well as pre-litigation claims and litigation subject matter expertise. This position also provides periodic legal training and legal updates. Regular business travel is required. PRIMARY RESPONSIBILITIES: * Provide legal support for varying Direct Store Delivery ("DSD") efficiency projects, as well as provide advice on varying compensation structures for hourly & commissioned employees. * Support internal restructure and/or reorganizations as the DSD business continues to grow. * Day-to-day employment law counseling and advice for Nestlé and affiliated companies. * Identify risks and trends, and develop proactive strategies and solutions for HR. * Enable and remove obstacles to support HR and business partners – frontline focus to ensure Nestlé wins in the marketplace. * Manage docket of administrative charges, pre-litigation claims, investigations and audits. * Provide subject matter expertise in support of litigation counsel with respect to employment-related litigation as needed. * Provide training and other updates to stakeholders and ongoing training on pertinent topics, including changes to employment laws, risk assessments, legal trends, and compliance. * Other duties, tasks, special projects, and responsibilities as assigned. SUPERVISION RECEIVED: Position operates under minimal supervision. SUPERVISION GIVEN: In addition to routine client counseling, may provide guidance and direction to support staff. Qualifications REQUIREMENTS AND MINIMUM EDUCATION LEVEL: * JD from accredited law school required. * Current membership in good standing in the Virginia State Bar or the ability to become Registered In House Counsel in Virginia. * Minimum of 4-6 years of experience as an employment lawyer, in-house counsel experience preferred. * Experience with litigating and counseling on employment matters in the areas of discrimination, disability accommodation, hiring, performance management and discharge, whistle blower, wage and hour, Department of Transportation compliance, organizational re-design and other labor and employment issues. * Experience drafting and/or advising on sales incentive programs and varying compensation structures. * Experience drafting employment-related contracts, executive summaries, forms, memoranda and pleadings, persuasive arguments, clear summaries of legal and regulatory requirements * Ability to concisely interpret compliance requirements into action plans for Human Resources and provide support to implementation. * Experience investigating and/or advising investigations of employment-related matters. * Excellent communicator with the ability to engage with and influence stakeholders across the company and at all levels of the organization. * Self-starter with willingness to take on special projects. * Background representing large, complex businesses and working with all levels of leadership.
