The Employment Attorney is responsible for providing strategic legal advice for the Wellforce health system, including its hospitals, agencies and physician organizations. The attorney will provide high-quality, practical advice and support to HR on a wide range of day-to-day issues including performance/conduct management, discipline and terminations, leaves of absence, disability, wage and hour, benefits and other matters in a fast-paced environment.
Provide support for management of US HR/employment matters, including agency/administrative charges and pre-litigation disputes. The attorney will also be responsible for investigation and evaluation of claims before administrative agencies and state and federal courts. The attorney will counsel and create workplace policies and procedures that follow federal, state, and local employment laws and help minimize conflict and lawsuits.# #
Responsibilities: Provide in-house legal counsel on labor and employment related matters such as, human resources issues, wage and hour law, workers# compensation, unemployment and other state agency claims, labor relations, employment agreements and policy related issues, FMLA matters, employment related litigation, grievances and arbitrations and generally assist the General Counsel and Human Resources Department. Oversee the investigation efforts for all incidents identified as potential claims, labor grievances and disciplinary procedures to ensure consistent practices are in place and align with the established union contracts. Evaluate current practices and ensures compliance; identify and pursue opportunities to reduce exposure and decide what strategies can be implemented to avoid litigation and what issues must be analyzed to determine potential financial exposure.# Act as the lead resource to other claims administrators to evaluate and plan litigation and assist in claim settlement negotiations.# Review confidential material contained in medical records and personnel files, abstracting pertinent information and summarizing statistically or in narrative form for review and analysis by other in-house lawyers or other appropriate parties.# Negotiate, within authority, claim settlements directly with claimants or their legal representatives/attorneys and partner when appropriate with third party administrators and related insurance companies through the claim process. Maintain advanced knowledge and awareness of current practices, techniques, trends, law and precedents regarding medical malpractice or product liability by participating in ongoing, independent study, education-related professional activities and affiliations.
Qualifications:
Juris Doctorate degree required Licensed to practice law in the Commonwealth of Massachusetts 7+ years working as an Employment Attorney with sound legal experience in worker#s compensation, harassment and discrimination, workplace safety, wage and overtime standards and privacy rights. Proven competence as an attorney; ability to manage heavy workload in a high-pressure environment.# Good communication (oral and written), research and interpersonal skills; must be proactive yet persistent in providing counsel.
Sound judgment; ability to clearly make reasoned recommendations; ability to cross think and determine who should be kept informed. Familiarity with hospital or healthcare environment#with an understanding of hospital operations and medical terminology.
