Employee Relations Specialist
Job Description Summary:
The Employee Relations Specialist is responsible for the interpretation, implementation and guidance on internal policies and employment laws; providing consulting services to managers at all levels regarding complaints of workplace misconduct, discrimination, retaliation, reasonable accommodation, code of conduct and policy interpretation/enforcement. This position will partner with the Labor Relations Department, Legal Department, regional and global compliance regarding investigations of alleged misconduct and other matters as needed. Investigate complaints as necessary and assist with the preparation of Position Statements. Provide support and facilitate resolution of ER/EEO issues related to progressive discipline, manage employee dismissal while minimizing risk; develop and sustain strong relationships with managers; identify trends and issues impacting employee relations; deliver training including respectful workplace, investigation, EEO and ADAA. This role reports to the Director, Employee Relations and will support the HR Managers across multiple accounts within C&W Services business lines in both the United States and Canada.
Responsible for the delivery of consulting services to managers on matters including, but not limited to: employee relations, performance management, leave of absence.
Investigate internal employee complaints of unfair treatment, harassment, discrimination, workplace violence or hostile work environment. Recommend solutions to management and dedicated HR team, including possible corrective action or termination based on legal risk factors to the organization.
Provide recommendations and the resolution for the complaint. Will partner with dedicated HR team on those issues that are highly complex or present significant risk.
Apply conflict resolution techniques to solve employee-manager and employee-employee issues or other situational conflict.
Responsible for facilitating the resolution of escalated Leave of Absence employment decisions and requests for workplace accommodations by influencing discussions with manager, employee, Legal and Benefits
Utilize Case Management tools to document and effectively manage ER matters and investigations; will become the Subject Matter Expert and Super User of the Case Management tool, generating reports and tracking trends; use data points to recommend solutions to mitigate risk.
Work with the HR team to ensure timely and accurate reporting of cases into the Case Management system.
Support HR team with research relating to internal investigations as needed.
Assist Sr. HR Managers with investigations, preparation and drafting of company responses relating to charges of discrimination and harassment.
Provide input and insight on holistic intervention and engagement efforts and remedies; may need to partner with Legal and ER on high level, high risk, or highly complex issues through resolution
Assist or take lead in the development of training, tools, templates, processes and reference materials, or other projects in support of the ER/EEO center of excellence function
Conduct training sessions as needed
Occasional travel to participate in investigations and meetings as needed
Bachelor's Degree, or the equivalent in related work experience
3+ years of Employee Relations/ experience
Bilingual English/Spanish (spoken and written) preferred
Skilled in managing and coaching through difficult ER situations as well as conflict resolution employment law, as well as deep and broad knowledge of Human Resources in general
Knowledge of general employment law including Title VII, ADAA, FMLA, ADEA, as well as broad knowledge of Human Resources
Knowledge of internal investigations principals including interviewing, due-process and performing credibility assessments
Strong business acumen and influencing skills as well as the ability to build credibility quickly
Organized working style, ability to handle and manage multiple priorities simultaneously through a systematic approach
Excellent consultation skills and the ability to seek out information and work effectively with all levels of employees within the organization
Proficiency in Word, Excel, Workday and the ability to learn new software is needed
