The Employee Relations and Compliance Specialist, reports to the Manager, Employee Relations. The Employee Relations and Compliance Specialist will be responsible for supporting the agency's employee relations and performance management functions. Ensuring employee records and documentation are compliant with agency policies, state and federal regulations, licensing and accrediting bodies, and funding sources. Working closely with multiple programs and departments throughout the agency, overseeing and guiding matters related to compliance and audits.

ESSENTIAL DUTIES & RESPONSIBILITIES

Employee Relations

  • Provides coaching and guidance to management on addressing employee relations matters including corrective actions, harassment, policy violations, employee grievance process, terminations and conflict resolution.

  • Assesses employment-related risk in partnership with Manager, Employee Relations and General Counsel.

  • Independently conducts investigations into alleged violations of policies.

  • Works with the Manager of Employee Relations and General Counsel to establish best practices, policies and procedures to keep current and ensure compliance with department of labor, and the federal and state employment laws and regulations

  • Supports the Talent Management Department in the implementation of strategic Employee and Labor Relations initiatives.

  • Partners with the General Counsel as needed for matters involving potential litigation.

  • Serves as a resource for employees who have work-related concerns, gathering information on employees' feelings about factors that affect workplace morale.

  • Communicates the need for compliance to employees regarding agency and governmental rules, regulations, and procedures.

  • Provides off-boarding process expertise including exit interviews.

  • Responsible for unemployment claims and processes.

  • Interviews employees to gather information on employee attitudes toward work environment and supervision received to facilitate resolution of employee relations problems.

  • Responsible for completing employment verifications.

  • Responsible for completing Public Service Loan Forgiveness applications in a timely manner.

Performance Management

  • In partnership with the Manager, leads and drives the design and delivery of Thresholds' performance management program, ensuring timely and successful completion.

  • Promotes the communication and training of the performance management process. Provides strategic performance management planning and execution.

  • Builds solid relationships with assigned manager/supervisor assisting them with appropriate Talent Management solutions to meet their needs; provides development and coaching when needed.

  • Provides proactive leadership and encourage positive change that leads to a high performing culture.

  • Participates in stay interviews and other retention initiatives.

Compliance

  • Responsible for maintenance and integrity of agency employee records to ensure required documentation is current and accurate. Ensures compliance with the policies of the Agency as well as Federal, State, Local, and other regulatory agencies. Reviews all records to determine missing or outdated documents.

  • Leads the preparation for agency audits including but not limited to CARF, DCFS, DFSS, BCBS, and BALC; creates action plans for resolution.

  • Conducts routine audits to ensure agency employee documents are current and accurate, including but not limited to employee licensure/certifications, Driver's license, Insurance information and transcripts.

  • Prepares and submits annual filings (i.e., EEO-1, VETS-4212, AAP) according to OFCCP guidelines.

  • In conjunction with the General Counsel, conducts the process related to the verification and compliance of VISA documentation.

  • Works with Risk Management regarding community support staff driving requirements, including regular audits of driver's license and insurance documents.

This position supports positive and effective employee and labor relations as well as serving as an employee relations content expert in an integrated HR business partner and practice center model in a unionized healthcare setting. The Employee and Labor Relations Manager leads and manages efforts in various areas of expertise, including improved data reporting and interpretive analysis, discovery of trends and opportunities, and identification of leading practices. This individual serves as a contact for segments of the organization without an assigned business partner, interprets Rush HR policies and procedures, collective bargaining agreements, and wide range of legal and compliance regulations. The individual who holds this position exemplifies the Rush mission, vision, and values and acts in accordance with Rush policies and procedures. Position Responsibilities: Labor Relations * Directly performs day-to-day labor relations activities including contract administration, labor management meetings, and information request. * Serves as second chair or chief negotiator during labor contract negotiations. Policy Development * Develops and implements processes and policies associated with city, state, and federal employment-based laws and regulations that apply to healthcare and are aligned with benchmarked leading practices. * Coordinates the development of updates to Human Resources Policies and Procedures including collaborating with stakeholders and drafting new policy language. Compliance * Provides interpretive guidelines and serves as a content expert to HR business partners as well as other Rush clients regarding labor contracts, HR policies and procedures, employment laws, reductions in force, and regulatory requirements. * Ensures structure, processes, and policies are in place to support a wide range of human resources-based legal and compliance requirements. Employee Appeal Procedure * Acts as a hearing officer and investigator for union and non-union formal and informal grievances, functioning as a mediator where appropriate. Diversity and EEO Compliance * Oversees all required diversity-related reporting including supporting the development and implementation of action plans. * Reviews and analyzes employee litigation to identify trends and develop recommendations to reduce litigation risks. * Oversees the general coordination of discovery responses, including coordination discovery responses for assigned business units. * Conducts investigations of discriminatory/harassment allegations as needed. Positive Employee Relations * Conducts needs assessment using a variety of data metrics. * Develops and delivers training as appropriate on employee relations issues, policies, and administrative procedures. * Develops and implements individualized employee relations interventions in collaboration with HR business partners. Position Qualifications Include: * Bachelor's degree required. * Master's degree preferred. * PHR or SPHR certification preferred. * Eight years of progressively more responsible work experience that includes a role in union negotiations and significant employee relations consultation. * Proficient in costing analysis of economic proposals. * Strong project management and critical thinking skills including proven problem-solving and planning skills. * Experience and interest in profess improvement techniques and benchmarking. * Ability to identify and analyze trends from a variety of data sources. * Excellent verbal and written communication skills that are adaptive to educationally and organizationally diverse audiences. * Ability to work collaboratively with diverse staff and a wide range of management levels and departments. * Self-directed, yet able to work in a matrix reporting structure and manage multiple priorities and projects. * Ability to build and maintain positive relationships internally and externally. * Extensive knowledge of applicable state and federal employment and labor laws and governmental compliance requirements. * Extensive knowledge of information technology, including software technology, used in the HR function.
