Position: Director of Compliance & Title IX Coordinator

Status: Full Time

Position Summary:

The Director of Compliance and Title IX Coordinator is responsible for developing, coordinating, implementing, and overseeing institutional compliance programs, including compliance with Title IX of the Education Amendments of 1972 (Title IX), the Violence Against Women Reauthorization Act (VAWA), and other applicable federal, state, and local laws and regulations that apply to the university. This position reports primarily to the General Counsel, with a dotted line report to the Vice President for Student Life and Christian Mission pertaining to Title IX matters.

The Director of Compliance and Title IX Coordinator will provide strategic leadership, collaborative oversight, and coordination of the university's compliance program. This role plays a significant part in ensuring the university complies with laws, regulations, and best practices driving a culture of ethics and compliance while demonstrating a tangible reduction in risk to the university. In addition, the Director of Compliance and Title IX Coordinator will carry out, monitor, and oversee the university's Title IX policy and processes, including coordination of training, education, communications, and the administration of complaint procedures.

Essential Duties and Responsibilities:

Compliance and Risk Management

Plan the strategic direction of, develop, and manage the university compliance program in accordance with federal and state guidelines; monitor the performance of the compliance program and related activities on a continuing basis, taking appropriate steps to improve effectiveness, prevent areas of noncompliance and recommend corrective action when necessary.

Serve as a visible and accessible resource for the university community seeking information or support related to regulatory compliance.

  • Support senior management and university leaders accountable for day-to-day compliance and risk mitigation; monitor and coordinate compliance activities across university departments to ensure all compliance related requirements are met, including timely submission of required reports and required storage/retention of documents.

  • Develop partnerships with student organizations, academic departments, and campus leaders to promote awareness and engagement around compliance issues, including but not limited to, Title IX, VAWA, the Clery Act, and FERPA.

  • Provide guidance to university leadership on general compliance issues, applicable laws and regulations, risk mitigation, and related topics, including ethics; provide updates to university leadership on a periodic basis on the status and progress of compliance and risk mitigation efforts.

  • Chair the university Compliance and Risk Management Committee.

  • Monitor, audit, and oversee compliance with university policies and procedures, including assigned federal and state laws, regulations, and compliance obligations.

  • Inform the General Counsel of known risks that arise from an impending lack of compliance; escalate information to the appropriate parties; collaborate with university departments to address and resolve compliance issues.

  • Develop and implement training modules for faculty and staff to support compliance and risk awareness.

  • In collaboration with the General Counsel, develop and recommend university policies and processes related to compliance and risk management to ensure compliance with federal and state laws and regulations and best practices in higher education institutions; conduct policy and compliance audits.

  • Implement communications and training strategies to publicize the university's compliance practices to internal and external stakeholders.

  • Develop and manage a comprehensive university-wide risk management program; monitor and analyze risks, perform internal audit tasks, and report findings to the university's senior leadership and, where appropriate, the Board of Trustees.

  • Monitor and remain current on applicable state and federal laws, regulations, and trends in higher education, including but not limited to, as they relate to Title IX, Clery Act, FERPA, VAWA, and the Office of Civil Rights.

  • Maintain current knowledge of best practices and industry trends in compliance and risk mitigation; engage in relevant professional development, internal and external, on a regular basis.

  • Research projects assigned by university leadership.

  • Work with outside insurance brokers and internal stakeholders on claims administration; manage annual insurance renewal process.

  • Review and modify contracts, including insurance and indemnification requirements, with guidance from the General Counsel.

Title IX Specific Responsibilities

  • Develop, oversee, and maintain processes for addressing Title IX complaints/reports of discrimination, harassment or sexual violence and related allegations of misconduct. Keep affected parties apprised of the existence and status of complaints. Ensure investigations of reports/complaints of sexual discrimination, harassment, and/or misconduct are adequate, reliable, timely, confidential, and impartial. Manage cases in compliance with Title IX, anti-discrimination, VAWA and Clery requirements.

  • Promptly coordinate and/or conduct investigations in response to alleged violations under Title IX filed by college students, staff, faculty and/or visitors in compliance with federal and state laws, executive orders, regulations and university policies and procedures.

  • Work with Deputy Title IX Coordinator and/or Title IX investigators on proposed sanctions for discriminatory harassment and misconduct to ensure they are reasonably calculated to stop the misconduct and prevent its recurrence.

  • Work collaboratively with Student Life, General Counsel, and the university's Deputy Title IX Coordinator to ensure informed and consistent communication in policy implementation.

  • Coordinate and collaborate with General Counsel to draft updates to the Title IX Policy based on federal guidance and regulations; assist in the formulation, review and revision of written policies, procedures, and guidelines related to Title IX compliance obligations and complaint procedures.

  • In collaboration with General Counsel, Human Resources, and Student Life, provide education, guidance and training to alleviate and prevent allegations involving prohibited conduct as defined in the Title IX Policy; maintain and update print and web-based materials that inform members of the campus community of Title IX rights and responsibilities; provide or facilitate training for the university community to promote knowledge of institutional policies and pertinent federal and state standards regarding Title IX, discrimination and sexual harassment prevention to staff and students.

  • Provide oversight of Title IX investigations, hearings, and appeals process; convene the Title IX Council and Title IX Appeals Committee as needed.

  • Coordinate and assist in protections associated with pregnancy, childbirth, false pregnancy, termination of pregnancy, or recovery from any of these conditions, including lactation needs, covered until Title IX.

  • Participate in ongoing training specific to Title IX to stay current on gender-based discrimination cases including implicit bias training, investigation training, coordinator training, and/or other training stipulated by federal regulations to stay informed about Title IX requirements.

  • Monitor and stay current on federal guidance associated with Title IX, including participation in various listservs related to Title IX.

  • Provide oversight and direction to the Deputy Title IX Coordinator, Title IX investigators, Title IX Advisors, Title IX Hearing Officers/Decision Makers, and the Title IX Appellate Officers, including adherence to federal training requirements for all parties as it relates to Title IX training.

  • Refer individuals to resources for supportive measures as necessary.

  • Maintain all records concerning reports, complaints, grievance processes, supportive measures, sanctions, remedies, and training.

  • Prepare and maintain required reports and information per federal and state law, as well as university guidelines.

Other Duties

  • Maintain a professional appearance and demeanor at all times.

  • Uphold and abide by Campbell University policies and procedures, including but not limited to Title IX, and Information Security, including but not limited to; HIPAA, FERPA and other state and federal mandates.

Education/Experience:

  • Must have Master's Degree, or Bachelor's Degree with minimum three years related experience in higher education, law, regulatory compliance, or related field;

  • Advanced degree (Master's Degree or Juris Doctorate) preferred;

  • Legal, regulatory, and/or compliance experience at a higher education institution or in industry preferred;

  • Title IX certification or ability to obtain within six (6) months;

  • Current ARM, CRM, and/or CCEP certification or ability to obtain within one (1) year of hiring; and

  • Experience in a higher education or non-profit sector desired.

  • Strong interpersonal, organizational, and critical thinking skills with solid judgment;

  • Comprehensive computer skills, with the ability to learn and utilize new and emerging technology;

  • Proficiency with Microsoft Word, Outlook, Excel, PowerPoint and standard methods of digital communication, including web/text/chat platforms;

  • Familiarity with IntelAgree or other contract management software system preferred;

  • Demonstrate tact, a positive attitude, courtesy, and discretion in dealing with trustees, faculty, staff, students, high-level university officials and the public;

  • Work independently as well as function effectively in a team and within a diverse group of people;

  • Exercise good judgment in complex, new, and/or stressful situations;

  • Manage multiple, concurrent projects, and meet set deadlines in a fast-paced environment;

  • Adaptability, flexibility, and a willingness to work in a changing environment;

  • Ability to work occasional evening or weekend hours, and occasionally travel, including overnight stays;
