Job Description

Basic Purpose

The Deputy General Counsel reports to the General Counsel (GC) and provides legal advice to the agency and board and represents OHCA in both administrative and judicial proceedings.

Typical Functions

  • Analyzes, reviews and researches copyright, trademark, software, and related issues for the agency. Provides legal support for IT issues in the agency as well as litigation support on these issues.

  • Represents the agency in administrative and judicial proceedings in both member and provider appeals. Prosecutes and defends administrative and judicial actions on behalf of the agency that involve more complex program issues within the Medicaid Program.

  • Reviews and analyzes contracts for the agency and drafts changes to those agreements to assist the agency in its mission.

  • Assists in the coordination of referrals and investigative efforts with the Office of the Attorney General/Medicaid Fraud Control Unit (MFCU).

  • Analyzes, reviews, and determines impact of proposed legislation.

  • Addresses contract bid issues. Reviews and analyzes agency contract bid documents, agency procurement manuals, evaluation tools, bidder's questions, and responses, and answer legal questions regarding pending procurement maters. This job requires legal knowledge of the Central Purchasing Act and legal research skills regarding procurement law. Provides legal support for administrative bid protest actions between the Office of Management and Enterprise Services, OHCA and bid protestants.

  • Addresses HIPAA and Open Records issues. Analyzes, researches and reviews record requests that involve the Open Records Act, HIPAA or Medicaid confidentiality laws.

  • Attends meetings of various interest groups to explain the Medicaid program and answers information requests from legislative members and staff.

  • Serves as principal contact for the provision of legal advice and attorney assistance to an administrative unit (e.g., Behavioral Health, Provider Services, etc.).

  • First- and second-chair responsibility in state and federal court proceedings involving the agency, including drafting of pleadings and discovery, motions hearings, depositions, trial, and appeal.

  • Researches state and federal law relating to the Medicaid program; drafts and/or reviews and revises State Plan and waiver language, as well as Oklahoma Administrative Code language; and attends meetings with internal and external stakeholders related to policy initiatives.

Travel: Travel on an "as needed" basis.

Qualifications: To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. This attorney position with the Oklahoma Health Care Authority states that the requirements listed below are representative of the knowledge, skill, and/or ability required.

Education and Experience

  • Bachelor's degree AND
  • Juris Doctorate Degree from ABA accredited Law School AND
  • A minimum of six (6) years of experience in the practice of law AND
  • Active Member of the State Bar of Oklahoma

Preference May Be Given to Candidates With:

  • Litigation experience

  • Other relevant legal and/or administrative experience

  • Significant background in health care administration, health care insurance and/or state or federal health care programs

  • Advanced education

  • Additional certifications

  • Use of computer research & case management software

  • Senior level administrative experience at OHCA

  • Legal experience at OHCA

Special Requirements

Physical Demands:

  • Must be able to remain sitting for prolonged periods at a desk and working on a computer.

  • Must be able to move or lift up to 15 pounds at various times.

Work Environment:

  • The office work environment includes regular exposure to general office equipment such as computer equipment, phones, and copy machines.
