KAR is seeking a Corporate Counsel, Labor & Employment to join its legal team and serve as the subject matter expert in all areas of federal and state labor and employment laws. The Corporate Counsel, Labor & Employment will provide legal advice and counsel to HR and other business teams on a variety of labor and employment related matters. The Corporate Counsel, Labor & Employment will report to the General Counsel or VP of Litigation and serve as the primary employment law resource for the entire organization.
Responsibilities and Duties:
Provide legal counsel and risk management advice to HR and management on a variety of labor and employment related matters, including internal investigations, discrimination/harassment claims, leaves of absence, reasonable accommodations, wage and hour issues, background checks, drug testing, employee discipline, terminations and separation agreements, layoffs, labor relations, collective bargaining, employment agreements and restrictive covenants, workplace violence, unemployment, employee classification, and general employee relations matters.
Advise on employee benefit matters, including qualified and nonqualified retirement plans, health and welfare arrangements, and other employee benefit plans, programs and arrangements.
Manages and represents the company in all employment, DOL, EEOC, and OSHA-related state and federal complaints, charges, and investigations.
Assist in the development, implementation and management of company policies and procedures, including employee handbooks and HR policies.
Develop and conduct training and compliance tools on a variety of employment law topics.
Draft, review and manage all employment-related agreements and templates, including offer letters, employment agreements, restrictive covenants, independent contractor agreements, temporary labor agreements, commission plans, separation agreements, performance reviews and disciplinary documents.
J.D. degree and membership in at least one U.S. state bar
5+ years of experience in labor and employment law (prior law firm experience preferred)
Must be proficient with the Microsoft Office suite of products and have the ability to learn all required business and matter management systems
Must be detail-oriented and organized with excellent communications skills (written and verbal) and interpersonal skills in dealing both inside and outside the organization.
Must be able to manage a heavy workload in a fast-paced environment.
Must demonstrate a high level of integrity and discretion in handling confidential information.
Must anticipate legal risks and be proactive in providing counsel, as well as utilize excellent judgment and analytical skills.
