Who we are looking for:

We are seeking a Corporate Counsel, Commercial Litigation to join our Legal team and assist with the Company's overall litigation management. This role is an important member of the Legal team responsible for driving and building upon our overall commercial litigation strategy, dispute resolution, and day-to-day litigation management. A successful candidate will be a strategic thought leader while supporting the day-to-day needs of the litigation team in its current state and as it grows. This role will report directly to the Assistant General Counsel - Employment & Litigation.

What you will do:

• Actively and consistently support all efforts to simplify and enhance the customer experience.

• Advise on litigation strategy and actively manage litigation (including pre-litigation) matters that affect ACV and/or its family of companies, including drafting and responding to discovery requests; preparing court filings, preparing witnesses and attending/conducting depositions, engaging in motion practice, and attending court as necessary.

• Analyze and assesses potential litigation risks and identify creative solutions to legal issues

• Handle and/or assist with handling, arbitrations, mediations, and, at times, investigations.

• Stay current with changes in commercial laws that may impact ACV.

• Manage litigation holds and the collection and review of documents and data for discovery, including through our eDiscovery vendor.

• Directly support litigation matters, subpoenas, and arbitrations and assist with supervising outside counsel on larger litigation matters.

• Develop and manage a nationally disbursed panel of outside counsel to assist with ACV's commercial litigation matters, including contract disputes and debt collection matters.

• Partner closely with internal business teams, including other members of the Legal team, Risk & Compliance, IT, Payments, and others to proactively address and resolve potential and actual commercial disputes in line with business objectives.

• Partner with business units to ensure we have the processes and operations to respond to and defend against litigation matters and to minimize litigation in the future, as well as assist with the development and improvement of litigation processes, including litigation holds, eDiscovery, and subpoena responses.

• Develop and maintain litigation management tools and metrics which both tracks status and trends on the Company's litigation portfolio.

• Provide status updates and litigation reports to key stakeholders on a periodic and as needed basis.

• Other duties as assigned.

What you will need:

• JD from an ABA-accredited law school and admission to at least one state bar

• 7 years' commercial litigation experience, including at least 3 years of litigation management experience in an in-house setting.

• Ability to read, write, speak, and understand English.

• Experience litigating a variety of complex commercial and contractual disputes on both plaintiff and defendant side. Experience in debt collection is helpful.

• Understanding of end-to-end litigation process, legal research, eDiscovery, and contract drafting and interpretation.

• Ability to work well under pressure with diligence, organization, and minimal supervision, and provide practical, business-friendly advice to clients.

• Strong analytical and strategic skills; ability to drive issues to a quick resolution that factors in business objectives.

• High degree of professional ethics and integrity.
