Job summary

The Red Hat Legal team is looking for a Commercial Litigation Attorney to join us at our corporate headquarters in Raleigh, NC. In this role, you will be responsible for working with outside counsel and on your own on general litigation and other matters. You'll need to have a combination of varied successful litigation experience, interest in and knowledge of technology, and passion for defending the open source mission.

Primary job responsibilities

  • Manage and guide strategy for a variety of commercial litigation and related matters, with experience welcome in tort, fraud, real estate, labor, and employment disputes, competition issues, and merger due diligence

  • Engage, collaborate with, and manage outside counsel in U.S. and other countries

  • Manage document preservation and internal discovery activities

  • Advise management and other internal customers regarding minimizing and addressing litigation risks

  • Be responsible for insurance-related notifications and issues

Required skills

  • JD degree from top-tier law school with solid academic credentials

  • State bar membership

  • 8+ years of experience in litigation; substantial experience in both law firm and in-house environments is a plus

  • Experience managing attorneys

  • Trial and appellate experience

  • Negotiating experience

  • Excellent writing and verbal skills

  • International law experience is a plus

  • Solid technology interest and aptitude is a plus

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $ 84,728 to $ 91,081. Salary offers are based upon the candidate's education and experience related to the position, as well as departmental budget and equity considerations. For current State employees, please note that as of June 1, 2018, promotional priority and salary administration will be made based on the new Statewide NC Classification System. The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake. This position is not subject to the Fair Labor Standards Act. This position is located in the Raleigh office of the Transporation Division of the N.C. Department of Justice. The Attorney III represents the N.C. Department of Transportation in eminent domain litigation at all levels of complexity. The attorney has responsibility for all phases of litigation in land acquisition proceedings, including investigation, trials in the superior courts, and appeals to the Court of Appeals and the Supreme Court. The attorney provides legal advice and representation to the Right of Way Branch with respect to questions of law involved in appraisal and valuation of properties. The primary duty of a trial attorney in this position is to represent the Department in the trial of eminent domain actions for the acquisition of real estate for highway purposes in cases where the Department's Right of Way Branch has been unable to effect settlement with landowners, and legal proceedings have to be instituted. This position requires travel and overnight travel. Knowledge, Skills and Abilities / Competencies In general, the knowledge, skills and abilities required for the Attorney III are those for the general practice of law with emphasis on litigation, that is, maintain effective working relationships with clients, witnesses, colleagues, court officials, judges, and jurors. More specifically, thorough knowledge of condemnation case law and civil procedure is required as well as the demonstrated ability to analyze complex facts and evidence. In addition, the demonstrated ability to conduct complex litigation in trial and appellate courts, including the ability to creatively develop case strategy and tactics, is required. The ability to oversee paralegals and less experienced attorneys who may assist in negotiations and trial preparations is necessary. Minimum Education and Experience Requirements Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise. Management preferences: Prefer candidates with condemnation and/or jury trial experience.
