The P&C Corporate Claims Division consists of over 100 professionals who support Great American's highly-diversified P&C claims operations across the world. The division's functional teams include Claims Practices, Claims Counsel, Claims Support Services, and Legacy Claims.

Claims Counsel is a team of lawyers providing claim- and coverage-related legal advice to our P&C divisions and affiliates. In addition to providing expert legal advice to existing internal clients, Claims Counsel lawyers seek to identify and develop opportunities to provide expert and cost-effective legal advice to P&C divisions not currently using Claims Counsel services.

Responsibilities

The Senior Claims Counsel position will be responsible for providing legal analysis, advice, and counsel on all assigned issues, claims and litigation. This position will provide advice and counsel to the Corporate Claims division and other P&C divisions with an emphasis on:

  • Legal research and written coverage analysis;

  • Interpreting and applying insurance contract provisions in the context of applicable cases, statutes, and regulations;

  • Managing coverage disputes and coverage litigation, including providing advice to business partners on discovery responses, procedural issues, deposition preparation, motion practice, resolution strategy and trial preparation; and

  • Developing appropriate content and strategy for coverage position letters to insureds and other parties.

This position may also be assigned to:

  • Ensure that outside counsel comply with corporate litigation management expectations and standards;

  • Assist business partners in evaluating the performance of outside coverage counsel;

  • Monitor, synthesize, and communicate with business partners regarding existing and developing statutes, regulations, case law, court rules and legal environment with respect to claims-related issues and practices;

  • Advise on appropriate and jurisdictionally applicable claims handling practices and coordinating with the P&C Legal Department on potential extra-contractual exposures on assigned claims;

  • Partner with staff in the Product Data Compliance area to identify opportunities for product improvement, assist with drafting of contract wordings, and help to spearhead cross-divisional product development dialog, initiatives and projects; and

  • Develop and deliver high-quality training and educational programming for internal claims and underwriting audiences relating to any of the substantive areas for which the position is responsible.

The candidate must be able to work effectively and collaboratively in a "matrix" environment involving multiple stakeholders, including underwriting business partners and the P&C Legal Department

Qualifications

Candidates must possess a J.D. from an accredited law school and must be licensed to practice law and in good standing in at least one US state. Candidates should have a minimum of five years of litigation, corporate advising, or equivalent experience, with a focus on the legal analysis of complex legal issues and an exposure to insurance coverage and extra-contractual liability issues and claims. Experience in insurance coverage analysis in the auto liability or trucking areas would be very useful. Substantial insurance coverage litigation experience is a plus.

The Property and Inland Marine Division (P&IM) writes policies in all 50 states and has more than 2,000 independent agents offering our coverages. Our broad range of products include Commercial Property, Builders' Risk, Contractor's Equipment, Excess Property, Transportation / Cargo, Electronic Data Processing (EDP), and Difference in Conditions policies (DIC). P&IM is currently searching for a Claim Representative / Senior Claim Representative / Claim Secialist to investigate, evaluate and settle commercial property and inland marine claims. Willingness to travel, including some overnight travel as needed. Job title and grade will depend on the successful applicant's level of experience. Responsibilities * Confirms and evaluates coverage and/or liability on medium to complex exposure cases. Secures and analyzes necessary information (i.e. expert reports, policies, appraisals, releases, statement, and other necessary documentation) in the investigation of claims. * Works toward the resolution of claims, and may attend arbitrations, mediations, depositions, or trials as necessary. * Affects settlements and reserves within prescribed time limits and submits recommendations to management on cases exceeding personal authority. * Conveys moderately complex information (coverage, decisions, outcomes, etc.) to all appropriate parties, maintaining a professional demeanor. * Ensures that claim payments are issued in a timely and accurate manner. * Performs other duties as assigned Qualifications * Must have a minimum of 3-6 years of experience handling property claims. * Commercial property claims experience is preferred. Inland Marine experience is a plus. Restoration and/or construction experience will be strongly considered. * Working knowledge of insurance coverages, commonly used insurance concepts, practices, and procedures. * Thorough knowledge and skilled at investigative techniques. * Must have a strong working knowledge of PCs, and computer software. * This position requires a high skill level in planning and organization, as well as written and verbal communications. * Bachelor's degree and/or AIC, CPCU, SCLA, and other insurance related designations are highly regarded. * Ability to manage and control independent adjusters, experts and outside counsel as necessary.
