The Position

Actively handle a small caseload of New York Labor Law claims and supervise a team of examiners that have a full pending of New York Labor Law claims. Manager will review tender responses and coverage letters for the New York Labor Law claims unit. Communicate with insured and other claim related parties, ensure a thorough investigation and coverage analysis is completed, work with defense and coverage counsel, formulate and execute plans of action, effectively analyze exposure through contractual risk transfer, liability and damage assessment. Set timely and appropriate reserves and negotiate resolution of cases through mediations, trials, and other proceedings. Maintain a working relationship with business line leaders, underwriters, brokers and agents to assist in account evaluation.

Job Responsibilities

  • Provide oversight to third party administrators on large construction, programs and national accounts.

  • Review, approve and/or submit all drafted large claim reports analyzing coverage, liability and damages for purposes of assessing the recommended reserves.

  • Prepare and present written and oral reports to senior and executive management setting forth all issues influencing evaluation and reserve recommendation.

  • Assist underwriters with drafting new form endorsements based on recognized trends in the book of business.

  • Arrange internal training sessions for department.

  • At least 5-7 years related claims/coverage experience

  • Management experience in claims/legal

  • New York Labor Law/construction experience necessary

  • Proper Adjuster Licensing in all applicable State


  • College degree, JD Preferred

Scope The Environmental Claim Specialist is responsible for investigating and settling high exposure, high risk claims. Insure high level of customer service and claim file quality. Responsibilities Duties include, but are not limited to: * Receives assignments and reviews claim and policy information to provide background for investigation and may determine the extent of the policy's obligation to the insured as it relates to first party clean-up activities subject to Federal (RCRA, CWA, CERCLA, and/or CAA) or state law. * Contacts, interviews and obtains statements (recorded or in person) from insureds, environmental consultants, engineers, attorneys, and experts to secure necessary claim information. * Evaluates facts supplied by investigation to determine extent of liability of the insured, if any, and extend of the company's obligation to the insured under the pollution policy. * Prepares reports on investigation, settlements, claims position letters, individual evaluation of involved parties etc. * Sets reserves within authority limits and recommends reserve changes. * Reviews progress and status of claims with severity exposures. * Assists manager in developing methods and improvements for handling claims. * Settles claims promptly and equitably. * Obtains releases, proofs of loss or compensation agreements and issues company drafts in payments for claims.
