Job Description and Duties

Under the general direction of the Executive Officer, the Attorney IV functions as Senior Counsel to the Executive Officer and Fast Food Council on all matters coming before the Council. This position requires the Attorney IV to assume the responsibility of Senior Counsel to the Executive Officer of the Fast Food Council (Executive Officer) and the Fast Food Council (Council).

The Senior Counsel will independently perform the complex and sensitive labor and employment legal services of the Council with broad discretion. In addition, the Senior Counsel will provide advice or opinions to the Executive Officer and Council on legal issues. The Senior Counsel will also provide advice or opinion on the legal effect of rules, regulations, proposed legislation, statutory law, court decisions, and administrative actions. The Senior Counsel is expected to develop strategy and tact in handling complex legal issues and is responsible for preparing cases which may result in litigation before boards, commissions, hearing officers, administrative law judges, and trial or appellate courts.

Duties include but are not limited to: Drafting regulations and rulemaking packages, conducting legal research, and providing legal guidance.

Working Conditions

This position is located in Sacramento, in an air conditioned, low-rise office building with natural and artificial lighting.

The incumbent works 40 hours per week. This position is eligible for remote-centered hybrid telework up to three days per week; the other two days per week are in the Sacramento office. The incumbent is regularly required to remain in a stationary position, communicate and to work at a computer for extended periods of time and to move and transport office items in a safe manner.

The incumbent will be required to travel occasionally.

Candidates who reside outside of the State of California may be admitted to the job interview, but they must show proof of residence in California prior to being eligible for appointment.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

  • Knowledge concerning the work of the Department, labor and employment law, wage and hour law, and workers' compensation law.

  • Prior experience serving as counsel to a public agency.

  • Prior experience writing and filing briefs in the California Court of Appeal and/or California Supreme Court and/or federal courts.

  • At least five years of civil litigation experience.

  • Prior experience analyzing and working on legislation and/or administrative regulations.

  • Strong interpersonal skills and the ability and desire to contribute to a collegial office environment.

  • Proficiency in Word and other Microsoft applications.
