Job Responsibilities:

  • Advises DPH state office and public health district staff, including district privacy officers, on compliance with the Health Insurance Portability and Accountability Act ("HIPAA") and other privacy issues.

  • Reviews and provides feedback on data requests made to DPH to ensure HIPAA compliance.

  • Conducts investigations of potential HIPAA breaches.

  • Advise on legal issues related to the Open Records Act or other federal or state privacy laws and assist with document requests as needed.

  • Partners with program staff on contracts, data sharing agreements, and memoranda of understanding.

  • Identifies and analyzes potential risks in program operations and agreements and proposes alternative options to mitigate risks.

  • Researches and analyzes legal issues affecting DPH and its programs.

  • Maintains knowledge of applicable state and federal statutes and regulations.

  • Drafts policies, new or amended legislation, forms, letters, notices, and other legal documents as requested.

  • Perform all other duties as assigned by the DPH General Counsel.

Juris Doctorate from an accredited college or university and licensed to practice law in Georgia, and which includes four (4) years in a managerial role in job-related legal experience.
