The Assistant General Counsel for Privacy will be an integral part of our legal department at Moody's. Along with maintaining current knowledge of applicable US and international privacy and cybersecurity laws and standards, monitor new developments to facilitate organizational adaptation and compliance. While designing and implementing a global privacy law compliance program, including processes for the completion of personal information inventories, privacy impact assessments, and data protection policies and procedures

  • Create and retain a data record inventory of data processing activities of the company and any other privacy-related documentation required by the GDPR or similar laws or regulations

  • Coordinate with other members of the legal team, information security and business stakeholders to ensure existing and new products, services and processes comply with applicable privacy requirements

  • Oversee, direct and assist with delivery of privacy training to company employees

  • Support incident response team for incidents or breaches involving personal data

  • Act as privacy subject matter expert in the negotiation and implementation of contract terms concerning data privacy and protection, between the company and vendors, third-party contractors, suppliers, customers, and agencies

  • Liaise with privacy and cybersecurity professionals at peer companies and industry organizations to benchmark efforts and learn best practices

  • Experience managing privacy programs from inception to operation, including privacy risk and compliance management, metrics tracking, privacy training development and deployment, and incident management

  • Strong technical understanding relating to IT environments, cloud computing and the online space (e.g., social media, cookies, mobile apps, big data analytics, etc.), with particular focus on how these technologies are used to communicate, collect, use and/or share personal data

  • Strong project management skills with proficiency in managing multiple projects simultaneously

  • Minimum of 10+ years of experience in a role focused on data privacy/protection compliance.

  • Law degree from well-respected university.

  • Certification in privacy and data protection (CIPP, CIPM or CIPT) is a plus

  • Prior experience in the financial services /business information provider industries or B2B industry is an advantage

  • Experience working in a multi-national corporation (in particular, headquartered in the U.S.) or experience working on projects involving stakeholders from multiple jurisdictions strongly preferred

  • Excellent leadership and communication skills, and desire to work as part of a global team in a fast paced environment

A successful candidate will be a leader and business partner for all of Topps' diverse divisions - sports & entertainment, confectionery and digital - who can counsel all stakeholders across the global organization. We operate and have offices in the United States, the UK and throughout Europe, Latin America and India. Responsibilities * Support all business groups (sports & entertainment, confectionery, digital) on all commercial legal matters * Ongoing management and oversight of Topps' global IP portfolio, including trademarks, patents, copyright and other IP * Anticipate and identify issues and risks, recommending potential solutions, and identifying trends in the areas of law relating to intellectual property and licensing * Provide legal guidance for issues that arise in connection with prospective and ongoing commercial engagements, including IP consultation, contract interpretation and advising on contractual and IP implications * Conduct preliminary trademark and patent searches through various databases and collaborate with business and legal teams (and outside counsel) to prepare, file and prosecute trademark and patent applications * Negotiate and draft complex commercial agreements, including license agreements (outbound and inbound), distribution, manufacturing and supply agreements, technology agreements, sponsorship and talent agreements and all other types of agreements related to the multiple business divisions * Advise business stakeholders with respect to various types of IP-related contracts, including for example, confidentiality, consulting agreements, product development agreements, etc. * Manage intellectual property matters involving various issues including 1st amendment, fair use, parody and similar matters * Review marketing and product materials * Advise on development, execution, and compliance for promotions, including sweepstakes and contests, special offers, and use of influencers and other advertising * Assist in general corporate and IP-related litigation issues * Provide IP-related advice and support for corporate transactions * Serve as liaison between Topps and outside counsel * Develop and implement policies and training required to educate employees on best practices for complying with applicable laws and managing business-related business risks Qualifications Key Skills/Knowledge * Significant experience in the development and management of intellectual property * Knowledge of global legal concepts applicable to intellectual property matters * Specific knowledge of key local country laws (e.g., US, UK) applicable to intellectual property matters where Topps operates * Demonstrated experience counseling on a range of intellectual property, licensing and commercial law matters, including filing trademark, patent and copyright applications * Experience drafting and negotiating various types of complex commercial agreements, particularly license agreements * Demonstrated ability to think and act globally and strategically, and to appreciate regional interests while doing so * Strong interpersonal, oral and written skills and proven track record in managing and influencing internal client relationships * Must be a business partner who understands the strategic needs of the business * Ability to concisely and simply communicate complex legal issues * Must be a self-starter, highly motivated, possess a strong work ethic and able to function independently in a "hands-on" environment * Ability to work collaboratively as a team member and be able to interact effectively with individuals at all levels inside and outside the company, including high profile individuals and companies, senior leadership, and executive board members * Potential for some travel when required Experience * 6-8+ years of experience in a top-tier firm and in-house legal department, with an emphasis on consumer products, sports & entertainment and digital and ecommerce platforms * Familiarity with the business and legal aspects of, consumer products, licensing (in-bound and out-bound), sports and entertainment trends, consumer goods, e-commerce and popular brands * Familiarity with Topps' diverse brands or overall business a plus * Experience working across a global business is preferred * Law degree from accredited law school * New York Bar admission The Topps Company New York NY
