Summary

The Assistant District Attorney for the District Attorney's office is responsible for prosecuting criminal matters in the County of Delaware.

Essential Duties

Thoroughly prepare for trials, motions, and hearings.

Conduct comprehensive file reviews, including interviews with witnesses and victims, evidence examination, and site visits.

Formulate and negotiate offers with defense counsel.

Analyze relevant laws to assess case strengths and weaknesses.

Utilize sentencing guidelines for plea bargain offers and trial strategies.

Serve as the Commonwealth's representative in bench or jury trials.

Manage jury selection and draft jury instructions.

Conduct direct examinations of Commonwealth witnesses and cross-examinations of defense witnesses.

Present objections effectively during legal proceedings.

Prepare and present exhibits in accordance with rules of evidence.

Deliver persuasive closing arguments.

Maintain general case management, including adherence to judge-imposed deadlines and caseload maintenance.

Handle miscellaneous and summary appeals.

Negotiate plea bargains for summary citations and, if necessary, conduct trial de novo on charges.

Manage hearings for indirect criminal contempt charges related to Protection from Abuse Orders.

Undertake additional duties, tasks, and special projects as required.

Qualifications

Juris Doctorate degree from an accredited law school.

License to practice law in Pennsylvania.

Strong legal research skills.

Excellent writing and reading skills.

Ability to work independently with meticulous attention to detail.

Exceptional verbal and written communication skills.

Capacity to establish priorities and multitask effectively.

Proficiency in researching applicable case law and citing cases.

Attendance of 12 hours of Continuing Legal Education (CLE) annually.

Working knowledge of Pennsylvania Rules of Criminal and Appellate Procedures and Rules of Professional Conduct for Attorneys.

Possession of a valid driver's license.

Additional Information

Three years of experience as a law clerk.

Familiarity with legal processes involved in Clerk of Courts and Prothonotary civil and criminal dockets.

Outstanding organizational and time management skills.

Ability to maintain confidentiality and handle sensitive information.

Demonstrated sound and accurate judgment.

Proficiency with modern office equipment and computer software.

Intermediate skill in using a personal computer and various software packages.

Ability to follow written or verbal instructions with common sense understanding.

Capacity to remain focused on daily operations.

Effective interfacing with all levels of county management.

Computer Skills

Basic to Intermediate proficiency in Microsoft Word and Outlook.

Competency in Westlaw legal research skills and experience with Court system software.

Physical Demands

While performing the duties of this position, the employee is frequently required to sit, climb stairs, and talk or hear. Occasionally, the employee will need to stand, walk, lift and carry items, and drive to and from different locations. On rare occasions, the employee will need to work with arms above shoulder height; kneel, stoop, crouch or squat; and drive a vehicle to and from different locations.

Work Environment

The noise level in the work environment is usually quiet.

Will work inside 100% of the time.

This position requires sitting for extended periods of time.

Must be available to work extended hours as necessary.
