The Office of Attorney General Tim Griffin is seeking to hire an experienced attorney to join his dynamic team in the Public Protection Division. This attorney will focus on complex litigation and investigations related to data breaches, cybersecurity, data privacy, and deceptive and unconscionable business practices in technology. The Assistant Attorney General selected for this role will be a leader in data protection and technology investigations. The Assistant Attorney General selected for this role will have the unique opportunity to help litigate complex technology cases and collaborate with state enforcers from attorneys general offices across the country.

The Public Protection Division protects consumers and the legitimate business community from deceptive trade practices, unfair business practices, and excessive utility rates or charges; mediates disputes between consumers and businesses; and educates the public regarding consumer issues. The Attorney General investigates and sues bad actors in Arkansas and Federal courts and often works with other Arkansas and Federal agencies and with other state attorneys general.

Candidates must be licensed to practice law in Arkansas and should have significant motion practice, discovery, and deposition experience. Experience with Plaintiff's class-action work, data privacy, cybersecurity, technology, knowledge of legal principles and practices relevant to the Arkansas Deceptive Trade Practices Act and the Arkansas Personal Information Protection Act, or other consumer protection statutes and regulations, and complex civil litigation experience are preferred. Assistant Attorneys General in the Consumer Protection Division carry a significant caseload. Successful applicants must be effective managers of their time and able to prioritize and delegate tasks.

The attorney hired for this position will provide legal representation to the State of Arkansas in matters involving deceptive or unconscionable business practices, primarily in technology, data privacy and data breaches, and matters affecting the interests of consumers. Additional duties include providing consumer education to the public, working with other state agencies, drafting legislation, and engaging with businesses and industry to maintain high standards of honesty and fair business practices.

This position requires daily in-office presence and the ability to travel in and out of state overnight occasionally. The applicant must be self-motivated to work collaboratively in a professional environment, exercise sound judgment, and communicate effectively. Assistant Attorneys General work under the supervision of Senior Assistant Attorneys General and a Deputy Attorney General.

Summary

Incumbent serves as an Assistant Attorney General within a division.

Functions

  1. Legal work performed is characterized as routine where factual questions are involved with clear applicable precedents.

  2. Incumbent is responsible to handle routine factual or policy issues that involve research, analysis, and obtaining expert testimony or information in areas of scientific, financial, corporate, medical, engineering, or other technical areas.

  3. Conducting legal research.

  4. Analyzing the factual and legal issues. Reviews policies, procedures, regulations, technical manuals, and other agency publications. Study industry and trade practices. Conducts research of laws, legal opinions, policies, regulations, legal texts, and precedent cases bearing on the legal issues involved in the problem, proposal, or case. Conducts pretrial examination of witnesses. Preparing memoranda or reports outlining the facts and legal issues, analyzing the factual and legal issues involved, explaining the application of legal principles and precedents, and justifying recommendations or conclusions.

  5. Provide legal representation to the State of Arkansas in matters involving deceptive business practices, data privacy, antitrust, and matters affecting the interests of consumers. Additional duties include providing consumer education to the public, working with other state agencies, drafting legislation, and engaging with businesses and industry to maintain high standards of honesty and fair business practices in the advertisement and sale of consumer goods and services. Knowledge, Skills and Abilities

Ability to complete work accurately with respect to legal citations, treatment of facts, and other aspects of technical treatment. Ability to produce written work that demonstrates soundness of approach and argument, application of legal principles, and that is consistent with the governing policies, procedures, and regulations of the employing agency.

Minimum Qualifications

Minimum of a Juris Doctorate from an accredited school of law. Prefer at least 3-5 years experience in a related field.

Licenses

Licensed to practice law in the State of Arkansas.
