The primary purpose of the North Carolina Department of Justice is to provide legal service to state government.  The primary purpose of the Transportation Division of the Department of Justice is to represent the North Carolina Department of Transportation (DOT) and the Board of Transportation.

The primary purpose of the Attorney III position is to provide legal services to the Department of Transportation in the areas of highway construction contract claims and litigation. The Attorney III also advises and represents DOT in government contracting, bidding disputes and other general contract matters.

 The position holder may also represent DOT in other miscellaneous areas of law and litigation as assigned.  The attorney performs other such tasks that are incidental to the performance of the work of the Department of Justice and the Transportation Division, including representing the state in criminal appeals.

Responsibilities and Duties:

 1. Provision of legal services to DOT in contract process and litigation.

  • The primary responsibility of this attorney is to represent and advise the Department of Transportation in all phases of highway construction contract claims and litigation.

  • The Attorney III reviews bid documents and contract documents and advises DOT on contract matters.

  • The Attorney III reviews verified claims made by contractors pursuant to N.C. Gen. Stat. § 136-29, attends verified claim hearings, makes recommendations as requested to the Verified Claims Review Board and State Chief Engineer, and represents DOT in any subsequent contract litigation in Superior Court or in the Office of Administrative Hearings.

2.Representation of the State in criminal appeals.

  • The Attorney III prepares briefs for the State in criminal appeals to the North Carolina Court of Appeals and Supreme Court.

  • Preparation of the brief requires reading and summarizing a trial transcript, reading the defendant's brief and the authority cited, researching relevant other authority and writing arguments on the questions raised.

3.Miscellaneous duties.

  • The attorney approves, as to form, bid bonds and contracts for highway projects. This activity occurs routinely, with contracts being assigned on a rotation by the administrative support staff.

This position is not subject to the Fair Labor Standards Act.

 Please detail ALL work history including non-state service experience.  If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO $84,878 to $100,179. DOT Funded. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Hybrid telework opportunities are available for this position.   Knowledge of case, statutory, regulatory, and common law.

Knowledge of civil procedure and the rules of evidence are required.

Ability to conduct civil litigation in the state and appellate courts. This requires highly developed skill in analyzing facts and evidence, interpreting and applying statutes, regulations, and case law, developing creative case strategy and tactics, and expressing legal arguments and conclusions clearly, concisely, and convincingly both orally and in writing.

Ability to establish and maintain effective working relationships with DOT employees at all levels, the judiciary, lawyers, and co-workers.Some state job postings say you can qualify by an "equivalent combination of education and experience." Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Credit for foreign degrees will only be given if verification of degree certification is attached to your application.  Transcripts for foreign degrees have to be evaluated by an organization like World Education Services to determine US equivalency.

Any licenses or certificates must be included in the appropriate section of the application form.

Veterans Preference: Applicants seeking Veteran's Preference must attach a copy of their DD-214 or discharge orders.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing.  If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
