Salary Recruitment Range: $84,878 - $102,703

Salary Grade: LG08

This position currently qualifies for a hybrid telework option with routine office and remote workday. The NC Department of Insurance trusts our employees to be self-motivated and successful in hybrid/remote roles. Telework options are subject to change at the discretion of management.

Mission of the Department of Insurance:

To promote a stable insurance market through unbiased regulation and to protect the lives and property of every citizen in all 100 counties while fostering superior, user-friendly service, courtesy, and respect.

Primary Purpose of the Position:

This position, under the supervision of General Counsel, gives legal direction and counsel to the Commissioner and all members of the Department in areas of law relating to the entities regulated by the Department, which include: the insurance industry, the bail bond industry, collection agencies, premium finance companies, professional employer organizations and building inspectors. This position also serves as the Departments hearing officer for a wide variety of administrative hearings under Article 3A of Chapter 150B of the North Carolina General Statutes.

This position, under the supervision of General Counsel, will be the primary point of contact for legal issues involving the Company Services Group. The Company Services Group performs, among other things, financial analysis work to determine compliance with the solvency laws of North Carolina, including analyzing financial statements, mergers, acquisitions, independent auditor reports, actuarial reports, affiliated transactions, asset portfolios, and reserving practices. As such, experience utilizing generally accepted accounting principles, or statutory accounting principles is necessary. In addition, experience with general transactional work in complex business transactions is preferrable.

In addition, this position assists the Ratemaking Counsel with the litigating all rate matters for the Department of Insurance, including presenting extremely complex and technical information during the hearing as well as handling these cases through all stages of appellate review. Because rate filings are filed with the Department for multiple lines of insurance, this position could assist the Ratemaking Counsel with several rate filings pending in various stages of litigation at any given time.

  • Thorough knowledge of NC insurance laws and administrative rules

  • Experience utilizing generally accepted accounting principles, or statutory accounting principles.

  • Considerable knowledge of case, statutory, regulatory, and common law.

  • Considerable knowledge of judicial and quasi-judicial procedures.

  • Ability to conduct complex civil or criminal litigation in trial and appellate courts.

  • Ability to interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions.

  • Ability to analyze facts, evidence, and legal instruments.

  • Ability to express conclusions and arguments clearly and logically in oral and written form.

  • Ability to analyze legal problems and render formal opinions.

  • Ability to establish and maintain effective working relationships.

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Management Preference:

At least five years of progressively responsible professional legal experience; experience handling property and casualty insurance issues; and experience with drafting legislation and/or administrative rules.
